【摘要】： “村官”是指以村委會(huì)主任和村黨支部書(shū)記為首的基層自治組織領(lǐng)導(dǎo)人的總稱。法定自治意義上的“村官”出現(xiàn)于二十世紀(jì)八十年代,至今我國(guó)的“村官”隊(duì)伍陣容龐大,總數(shù)已逾500多萬(wàn)人�！按骞佟笔俏覈�(guó)社會(huì)主義新農(nóng)村建設(shè)的“領(lǐng)頭羊”。 近年來(lái),隨著社會(huì)主義體制改革的深入,多種綜合因素錯(cuò)綜交織,“村官”的職務(wù)犯罪行為有燎原之勢(shì),已經(jīng)成為一個(gè)事關(guān)農(nóng)村穩(wěn)定與發(fā)展的不容忽視的問(wèn)題。“村官”職務(wù)犯罪多集中于經(jīng)濟(jì)和民主選舉領(lǐng)域,以貪污、挪用、侵占及賄選等侵財(cái)型案件居多。其發(fā)生程度不論從廣度上還是深度上都令人驚心,這給本來(lái)就脆弱的農(nóng)村發(fā)展增添了巨大障礙,更加劇了城鄉(xiāng)二元化結(jié)構(gòu)的矛盾。 外因是事物變化發(fā)展之條件,內(nèi)因是事物發(fā)展的根據(jù)。“村官”職務(wù)犯罪形勢(shì)如此嚴(yán)峻,既有刑罰預(yù)防教育不到位、自治機(jī)制不健全及村民參政意識(shí)落后等外因,也有村官隊(duì)伍整體素質(zhì)亟待提高等內(nèi)因。我們應(yīng)該注重發(fā)揮刑法的威懾力,同時(shí)標(biāo)本兼治。 本文共分三部分內(nèi)容如下: 第一章提出了“村官”職務(wù)犯罪的課題,分析了我國(guó)“村官”職務(wù)犯罪的現(xiàn)狀、表象及特點(diǎn),并從刑法視角指出了“村官”職務(wù)犯罪在新形勢(shì)下的危害。 第二章討論了“村官”職務(wù)犯罪的法律特征和形成原因。對(duì)其常見(jiàn)的罪名作了分析,并就“村官”賄選是否屬于“村官”職務(wù)犯罪的范疇及如何填補(bǔ)法律空白問(wèn)題作了探討。 第三章分析了美國(guó)、奧地利、新加坡、印度等國(guó)外治理職務(wù)犯罪的經(jīng)驗(yàn)及教訓(xùn),覓尋共性以資借鑒。然后,討論了我國(guó)“村官”職務(wù)犯罪之源頭,指出我國(guó)治理過(guò)程中出現(xiàn)的種種問(wèn)題。最后,本著“借助刑法利器,綜合標(biāo)本兼治”的思路,對(duì)治理工作闡述了自己的見(jiàn)解。 通過(guò)以上論述,筆者得出以下結(jié)論:目前依法治理我國(guó)“村官”職務(wù)犯罪已刻不容緩。我們必須加強(qiáng)法學(xué)理論研究,注重完善刑事實(shí)體與程序法律體系。我們要發(fā)揮刑法的高效威懾作用,嚴(yán)厲打擊經(jīng)濟(jì)和民主選舉領(lǐng)域出現(xiàn)的“村官”貪污、挪用、侵占國(guó)家、集體財(cái)產(chǎn)及賄選等罪行,堵塞“村官”犯罪的漏洞。通過(guò)對(duì)農(nóng)村工作綜合治理,維護(hù)農(nóng)村的穩(wěn)定與發(fā)展大局。
[Abstract]:"Village officials" refers to the leaders of grassroots autonomous organizations headed by village committee directors and village party branch secretaries. The "village official" in the sense of statutory autonomy appeared in the 1980s. Up to now, the team of "village officials" in our country has a large lineup, with a total of more than five million people. Village officials are the leaders of the construction of new socialist countryside in China. In recent years, with the deepening of the socialist system reform, a variety of comprehensive factors intertwined, "village officials" of duty crimes have the potential to start a prairie fire, has become a problem related to the stability and development of rural areas can not be ignored. The crimes of "village officials" are mostly concentrated in the fields of economy and democratic election, such as embezzlement, embezzlement and bribery. The extent of its occurrence is alarming both in breadth and depth, which adds great obstacles to the fragile rural development and intensifies the contradiction of urban-rural dual structure. External causes are the conditions for things to change and develop, while internal causes are the basis for the development of things. The situation of "village official" duty crime is so severe that there are some external reasons, such as the imperfection of penalty prevention education, the imperfection of autonomous mechanism and the backward consciousness of villagers' participation in politics, as well as the internal reasons such as the overall quality of the village officials should be improved urgently. We should pay attention to giving play to the deterrent power of criminal law, and at the same time treat both symptoms and symptoms. This paper is divided into three parts as follows: the first chapter puts forward the subject of "village official" duty crime, analyzes the present situation, appearance and characteristics of "village official" duty crime in China. From the angle of criminal law, the author points out the harm of duty crime of village official in the new situation. The second chapter discusses the legal characteristics and causes of duty crime of village officials. This paper analyzes on the common charges, and probes into whether the bribery of "village official" belongs to the category of duty crime of "village official" and how to fill up the blank of law. The third chapter analyzes the experiences and lessons of foreign countries, such as America, Austria, Singapore, India and so on. Then, it discusses the origin of the crime of village officials, and points out the problems in the process of governance. Finally, in line with the idea of "using the sharp weapon of criminal law, comprehensive treatment of both symptoms and symptoms", the author expounds his own views on governance. Through the above discussion, the author draws the following conclusions: at present, it is urgent to deal with the crime of "village official" duty in our country according to law. We must strengthen the study of legal theory and improve the legal system of criminal entity and procedure. We should give full play to the highly effective deterrent effect of the criminal law, crack down on the corruption of "village officials" in the field of economic and democratic elections, misappropriate and occupy the state, collective property and bribery, and plug up the loopholes in the crimes of "village officials". Through comprehensive management of rural work, maintain the overall situation of rural stability and development.
