【摘要】：深化司法體制改革,要遵循司法活動(dòng)的客觀規(guī)律,堅(jiān)持符合國(guó)情與遵循司法規(guī)律相結(jié)合。作為司法改革的重要組成部分,偵查制度的改革也必然要遵循刑事司法規(guī)律,偵查權(quán)的運(yùn)行應(yīng)當(dāng)符合偵查權(quán)的運(yùn)行規(guī)律。對(duì)偵查權(quán)運(yùn)行規(guī)律的研究應(yīng)當(dāng)是多視角的。偵查權(quán)運(yùn)行規(guī)律的外延既包括方法論層面上的偵查權(quán)內(nèi)生性規(guī)律,也包括訴訟法學(xué)層面上的偵查權(quán)外源性規(guī)律。前者是對(duì)偵查權(quán)運(yùn)行本質(zhì)的一種現(xiàn)實(shí)描述,包括偵查權(quán)運(yùn)行是探索性的而非判斷性的,是隱秘性的而非公開(kāi)性的,是效率優(yōu)位的而非公正優(yōu)位的;后者則是偵查權(quán)運(yùn)行的一種應(yīng)然需要,包括偵查權(quán)運(yùn)行應(yīng)當(dāng)嚴(yán)格依照法律,應(yīng)當(dāng)以審判為中心,應(yīng)當(dāng)恪守比例原則。在我國(guó),刑事訴訟的運(yùn)行傾向于職權(quán)主義模式,偵查權(quán)嚴(yán)重泛化,造成實(shí)踐當(dāng)中的諸多問(wèn)題,原因主要在于偵查權(quán)運(yùn)行兩大規(guī)律之間的沖突沒(méi)有得到有效的調(diào)和,偵查權(quán)在運(yùn)行體制上缺乏司法權(quán)的有效介入,運(yùn)行機(jī)制上缺乏公訴權(quán)的合理引導(dǎo),運(yùn)行過(guò)程中缺乏辯護(hù)權(quán)的充分參與,需要依據(jù)偵查權(quán)的運(yùn)行規(guī)律加以健全。完善路徑應(yīng)為確立司法審查與令狀許可制度,健全程序性制裁體系,強(qiáng)化對(duì)偵查權(quán)運(yùn)行的司法控制;推行檢警一體化的偵查模式,探索公訴權(quán)對(duì)偵查權(quán)的合理引導(dǎo);貫徹?zé)o罪推定原則,保障辯護(hù)權(quán)在偵查程序的有效參與。
[Abstract]:To deepen the reform of judicial system, we must follow the objective law of judicial activities and adhere to the combination of conformity with the law of judicature. As an important part of the judicial reform, the reform of the investigation system must follow the law of criminal justice, and the operation of the investigation power should conform to the law of the operation of the investigation power. The research on the law of investigation power operation should be from many angles. The extension of the law of investigation power includes not only the inherent law of investigation power in methodology level, but also the exogenous law of investigation power on the level of procedural law. The former is a realistic description of the essence of the operation of the investigation power, including that the operation of the investigation power is exploratory rather than judgmental, secretive rather than open, and that the operation of the investigation power is superior to efficiency rather than justice; The latter is a necessary requirement for the operation of investigation power, including the operation of investigation power should be strictly in accordance with the law, should take trial as the center, and should abide by the principle of proportionality. In our country, the operation of criminal procedure tends to the mode of authority doctrine, and the investigation power is seriously generalized, which causes many problems in practice. The main reason is that the conflict between the two laws of the operation of investigation power has not been effectively reconciled. The right of investigation lacks the effective intervention of judicial power in the operation system, the reasonable guidance of the right of public prosecution in the operating mechanism, and the full participation of the right of defense in the course of operation, which needs to be perfected according to the law of operation of the power of investigation. The perfect path should be to establish the system of judicial review and writ permit, perfect the system of procedural sanction, strengthen the judicial control over the operation of investigation power, carry out the investigation mode of the integration of procuratorial and police, and explore the reasonable guidance of the right of public prosecution to the power of investigation. Implement the principle of presumption of innocence and ensure the effective participation of the right of defense in the investigation procedure.
