【摘要】：2006年2月3日臺(tái)灣地區(qū)“法院組織法”修訂后,特偵組正式成為臺(tái)灣“最高法院檢察署”的內(nèi)設(shè)機(jī)構(gòu),專門(mén)負(fù)責(zé)偵查起訴“政府”高級(jí)官員的貪污腐敗犯罪、重大選舉違法犯罪以及特殊重大貪瀆經(jīng)濟(jì)犯罪、危害社會(huì)秩序的犯罪。其前身是成立于2000年7月1日的臺(tái)灣“高等法院檢察署”查緝黑金行動(dòng)中心特偵組。同時(shí),修訂后的“法院組織法”還規(guī)定特別偵查組檢察官執(zhí)行職務(wù)時(shí),可以執(zhí)行各審級(jí)檢察官的職權(quán)。特偵組檢察官可以根據(jù)案件的性質(zhì)和法律規(guī)定的管轄原則,分別行使一、二、三審檢察官的職權(quán)。特偵組檢察官也不受轄區(qū)的限制,一般檢察官在行使職權(quán)時(shí),除遇有緊急情況或法律另有規(guī)定的情形外,只能在其所屬檢察署管轄區(qū)域內(nèi)行使職權(quán),而特偵組檢察官行使職權(quán)并無(wú)具體轄區(qū)的限制,特偵組檢察官可以跨越不同轄區(qū)向案件的該管法院行使職權(quán)。在這兩個(gè)視角下,可以說(shuō)特偵組檢察官是一種特別檢察官。設(shè)置特偵組的目的,一是要打破轄區(qū)和審級(jí)的限制,以“最高檢察機(jī)關(guān)”內(nèi)設(shè)機(jī)構(gòu)的法律地位,將特偵組定位在檢察體系中頂點(diǎn),確保特偵組辦案的公正性、獨(dú)立性；二是組建高層次的專業(yè)化偵查機(jī)構(gòu),以打擊目前朝向企業(yè)化、結(jié)構(gòu)化、復(fù)雜化發(fā)展的新形勢(shì)犯罪；三是以團(tuán)隊(duì)辦案的方式克服檢察官獨(dú)任辦案、單打獨(dú)斗的傳統(tǒng)辦案方式的弊病,提高偵查質(zhì)量,同時(shí)在新、老檢察官之間實(shí)現(xiàn)經(jīng)驗(yàn)傳承。但是,在特偵組的實(shí)際運(yùn)行中,仍會(huì)面臨諸如領(lǐng)導(dǎo)人特權(quán)、檢察一體化下的內(nèi)部干預(yù)等問(wèn)題,特偵組想要獨(dú)立并公正地實(shí)現(xiàn)對(duì)所管轄案件的查辦、追訴,也并不輕松。
[Abstract]:In February 3rd 2006, after the revision of the Law on the Organization of the Courts in the Taiwan region, the Special investigation team formally became the internal body of Taiwan's "Supreme Court Public Prosecutor's Office," dedicated to investigating and prosecuting corruption crimes committed by "senior government" officials. Major election crimes, major corruption and economic crimes, and crimes against social order. Its predecessor was the Special investigation Section of Taiwan's "High Court Public Prosecutor's Office" for the investigation of Black Gold Action Center, which was established on July 1st 2000. At the same time, The revised Law on the Organization of the Courts also provides that when the procurators of the special investigation teams perform their duties, they may perform the functions and powers of the procurators at the trial level. According to the nature of the cases and the principles of jurisdiction prescribed by the law, the procurators of the special investigation teams may exercise one or two of them respectively. The functions and powers of the procurators of the third instance. The procurators of the special investigation team are also not restricted by the jurisdiction. In the exercise of their functions, public prosecutors may exercise their functions only in the areas under the jurisdiction of their public prosecutors' offices, except in cases of emergency or otherwise provided for by the law. However, there are no restrictions on the prosecutors of the special investigation team to exercise their functions in specific jurisdictions. The prosecutors of the special investigation team can exercise their functions across different jurisdictions to the competent court of the case. From these two angles of view, It can be said that the procurator of the special investigation group is a kind of special procurator. The purpose of setting up the special investigation group is, first, to break the limits of jurisdiction and the level of trial, to take the legal status of the "supreme procuratorial organ" as an internal institution, and to position the special investigation group at the apex of the procuratorial system. To ensure the impartiality and independence of the special investigation team, to set up a high-level specialized investigation organization in order to crack down on the crime in the new situation, which is oriented towards enterprise, structure and complex development; Third, to overcome the shortcomings of the traditional way of handling cases by the procurator alone, and to improve the quality of investigation, and at the same time to carry out the experience transmission between the new and the old prosecutors. However, in the actual operation of the special investigation team, Still facing problems such as the privileges of leaders and internal interference under the integration of prosecution, it is not easy for the special investigation team to independently and impartially carry out the investigation and prosecution of the cases under its jurisdiction.
