【摘要】：人們通常認(rèn)為,相比于其他職業(yè)而言,法官應(yīng)當(dāng)負(fù)有更高的道德責(zé)任,但是,這個(gè)觀念的確切意義仍有待探究,因?yàn)闊o(wú)論是法官責(zé)任還是道德責(zé)任,都存在多重的面向。事實(shí)上,法官高階道德責(zé)任的核心,并不在于盡量避免錯(cuò)誤以免受追責(zé),而是在于對(duì)法律命題作出最佳的道德證立,法官應(yīng)擺脫"平庸之惡",矢志追求司法的卓越品質(zhì)。這意味著對(duì)法官責(zé)任的認(rèn)定和規(guī)范,應(yīng)當(dāng)實(shí)現(xiàn)從法官責(zé)任向法官職業(yè)倫理的轉(zhuǎn)變。
[Abstract]:It is generally believed that judges should have a higher moral responsibility than in other professions, but the exact meaning of this concept remains to be explored, both in terms of judge responsibility and moral responsibility. In fact, the core of the high moral responsibility of judges is not to avoid mistakes to avoid liability, but to make the best moral proof of legal proposition. Judges should get rid of the "mediocre evil" and pursue the outstanding quality of the judicature, which means that the judge's responsibility should be recognized and standardized, and the transformation from the judge's responsibility to the judge's professional ethics should be realized.
