【摘要】：政策是國(guó)家權(quán)力為了實(shí)現(xiàn)社會(huì)目標(biāo)、解決社會(huì)問(wèn)題而制定的公共行動(dòng)計(jì)劃、方案和準(zhǔn)則。司法政策是一個(gè)內(nèi)涵相對(duì)特定,但外延寬泛模糊的概念。所謂司法政策,是特定主體在一定的時(shí)期內(nèi),為反映和實(shí)現(xiàn)所代表階級(jí)、集團(tuán)、階層的特定利益與意志,并為了解決司法活動(dòng)中所面臨的問(wèn)題而采取、制定、遵循的措施、規(guī)程、原則以及一系列相應(yīng)活動(dòng)。[1]政策和法律經(jīng)歷了政策是法律的靈魂的“泛政策化”、法律高于政策的“泛法律化”及至今政策和法律的聯(lián)系很少提及的狀態(tài)。司法政策與司法活動(dòng)有著非常密切的關(guān)系,當(dāng)法律法規(guī)在司法運(yùn)行中所出現(xiàn)的漏洞、空白或無(wú)法適應(yīng)社會(huì)變化時(shí),司法政策發(fā)揮彌補(bǔ)功能。就司法政策的功能及司法政策特性來(lái)看,司法政策應(yīng)然意義上是以公平正義為最基本原則,但是由于我國(guó)正處于社會(huì)主義法治轉(zhuǎn)型這一特殊時(shí)期,審判者在作出裁判時(shí)大多數(shù)情況下都是依據(jù)固有法律,司法政策的作用被忽視。這不是社會(huì)發(fā)展的正常形態(tài),我們應(yīng)盡可能使司法政策發(fā)揮積極作用,積極穩(wěn)妥的推進(jìn)社會(huì)改革。但在實(shí)現(xiàn)的司法活動(dòng)中,司法政策也存在自身的合法性及合理性問(wèn)題,過(guò)度的尊重司法政策會(huì)對(duì)公民的權(quán)利構(gòu)成威脅,因此司法政策在司法活動(dòng)中既要能動(dòng)的適用又須謹(jǐn)慎克制。 第一部分,司法政策的基本理論。本章首先從司法、政策含義入手。引入司法政策的含義,并對(duì)司法政策在我存在的原因及基本屬性進(jìn)行分析。 第二部分,司法政策在我國(guó)存在的空間及司法政策對(duì)法治的作用。本章主要闡述了司法政策是我國(guó)司法的資源、司法政策與法律的關(guān)系及我國(guó)司法對(duì)司法政策的保障,從這三個(gè)方面分析司法政策在我國(guó)存在的必然性及合理性。另外,通過(guò)闡述司法政策與法治的關(guān)系,進(jìn)一步分析司法政策對(duì)法治的作用。 第三部分,我國(guó)主要司法政策的內(nèi)容分析。本章主要對(duì)刑事司法政策、民事司法政策、行政司法政策及國(guó)際司法政策進(jìn)行闡述,分析了其相關(guān)性質(zhì)及與部門法的關(guān)系,并選擇美國(guó)和德國(guó)這兩個(gè)代表普通法系及大陸法系的國(guó)家對(duì)其司法政策進(jìn)行分析。 第四部分,司法政策的執(zhí)行。本章主要闡述司法政策執(zhí)行的含義及特點(diǎn),分析司法政策執(zhí)行的原則及闡述司法政策的執(zhí)行過(guò)程。 第五部分,司法政策進(jìn)行社會(huì)管理的理由、障礙及合理建議。結(jié)合司法政策在實(shí)際司法活動(dòng)中的作用及存在的問(wèn)題,提出相關(guān)合理的建議完善司法政策構(gòu)建。
[Abstract]:National policy is the power in order to achieve social goals, public action plan to solve the social problems and development, methods and rules. The judicial policy is a relatively specific connotation, but the concept of broad extension. The so-called judicial policy, is a specific subject in a certain period of time to reflect and realize the class, group, specific benefits and will of class, and in order to solve the problems faced in the judicial activities and take measures, formulate, follow the rules, principles, and a series of relevant policies and laws through the activities of the.[1] policy is the soul of the law of "extensive policy", the law is higher than the policy of "extensive law" and has policies and the legal relationship is seldom mentioned. The judicial policy and judicial activities have a very close relationship, when appearing in execution of loopholes in laws and regulations, blank or social change can not adapt to the judicial. The policy to remedy the function. The function and characteristics of the judicial policy of judicial policy, judicial policy should meaning is fairness and justice as the basic principle, but because our country is in the socialist transformation of the special period, the judge in the judgment are mostly based on the inherent law and judicial policy is this is not ignored. The normal form of social development, we should try to make the judicial policy play a positive role, actively and steadily push forward the reform of the society. But in the implementation of the judicial activities, the judicial policy also has its own legitimacy and rationality, excessive judicial policy will respect the rights of citizens to pose a threat, so judicial application the policy in the judicial activities should be active and must be prudent.
The first part is the basic theory of judicial policy. Firstly, from the perspective of judicature and policy implications, the meaning of judicial policy is introduced, and the reasons and basic attributes of judicial policy in my existence are analyzed.
The second part, the role of judicial policy for the rule of law in space and judicial policy in our country exist. This chapter mainly expounds the judicial policy is China's judicial resources, the protection of judicial policy and the legal and judicial of judicial policy, judicial policy analysis on the necessity and rationality of our existence from the three aspects. In addition, through elaborating the relationship between judicial policy and rule of law, further analysis of the role of judicial policy for the rule of law.
The third part, the main analysis of judicial policy in our country. This chapter focuses on the criminal justice policy, civil judicial policy, administrative and judicial policy and international judicial policy is expounded, analyzed its characters and relationship with the Department of law, and the choice of the United States and Germany, the two representative common law and civil law countries the judicial policy analysis.
The fourth part, the implementation of judicial policy. This chapter mainly expounds the meaning and characteristics of judicial policy implementation, analyzes the principles of judicial policy implementation and expounds the implementation process of judicial policy.
The fifth part, the reasons, obstacles and reasonable suggestions of judicial policy for social management. Combined with the role and problems of judicial policy in practical judicial activities, it puts forward some reasonable suggestions and consummate the construction of judicial policy.
