【摘要】：正涉眾型經(jīng)濟(jì)犯罪是指涉及眾多不特定受害群體的經(jīng)濟(jì)犯罪,主要包括非法吸收公眾存款、集資詐騙、非法傳銷、非法經(jīng)營(yíng)、非法銷售未上市公司股票等犯罪。另外,在詐騙、合同詐騙及金融犯罪中也會(huì)有涉眾因素存在。涉眾型經(jīng)濟(jì)犯罪不是刑法的分類概念,它是對(duì)這類具有涉眾性因素的犯罪的總體描述。我們對(duì)北京市檢察機(jī)關(guān)辦理的涉眾型經(jīng)濟(jì)犯罪案件進(jìn)行了調(diào)查,并提出了本報(bào)告。在研究涉眾型經(jīng)濟(jì)犯罪影響社會(huì)和諧穩(wěn)定的基礎(chǔ)上,就如何提升打擊犯罪的能力和參與社會(huì)管理創(chuàng)新,提出對(duì)策和建議。
[Abstract]:Positive stakeholder economic crimes refer to economic crimes involving a large number of non-specific victimized groups, mainly including illegal public deposits, fund-raising fraud, illegal pyramid selling, illegal operation, illegal sale of shares of unlisted companies, and other crimes. In addition, in fraud, There are also stakeholder factors in contract fraud and financial crimes. Stakeholder economic crime is not a classified concept of criminal law. It is a general description of this type of crime with stakeholder factors. We investigated the cases of stakeholder economic crimes handled by the procuratorial organs in Beijing. On the basis of studying the influence of stakeholder economic crime on social harmony and stability, this paper puts forward some countermeasures and suggestions on how to improve the ability to combat crime and participate in the innovation of social management.
