【摘要】:檢察機(jī)關(guān)以原告身份向法院提起公益訴訟已是當(dāng)前世界各國立法的大勢所趨,美國、英國、法國、德國、日本等國家分別建立了比較完善的檢察機(jī)關(guān)提起公益訴訟制度。在我國市場經(jīng)濟(jì)轉(zhuǎn)型過程中,出現(xiàn)了大量侵害國家利益和社會(huì)公共利益的案件,如國有資產(chǎn)流失案件、環(huán)境與自然資源的公害案件、壟斷經(jīng)營案件、不合理利用土地案件、破壞土地資源案件等公共性的違法侵害國家利益和社會(huì)公共利益的案件。但是,由于我國公益訴訟的原告制度在程序法上的缺失,致使對社會(huì)公共利益尋求司法保護(hù)的急迫社會(huì)需求與現(xiàn)行訴訟立法欠缺有關(guān)公益訴訟具體立法規(guī)定之間產(chǎn)生了矛盾。隨著司法改革向縱深發(fā)展以及理論界擴(kuò)張檢察權(quán)、借鑒國外檢察機(jī)關(guān)提起公益訴訟的立法例、加強(qiáng)我國檢察機(jī)關(guān)民事公訴權(quán)的大聲疾呼,檢察機(jī)關(guān)提起公益訴訟已從司法實(shí)踐進(jìn)入了理論設(shè)計(jì)與制度設(shè)計(jì)的層面。對其進(jìn)行深入系統(tǒng)的研究,構(gòu)建一系列符合我國國情的檢察機(jī)關(guān)提起公益訴訟的制度,以保護(hù)國家利益和社會(huì)公共利益不受侵犯,已經(jīng)成為中國檢察制度改革發(fā)展的方向之一。本文通過對檢察機(jī)關(guān)提起公益訴訟制度的理念基礎(chǔ)、域內(nèi)外考察、路徑選擇等的分析與探討,力圖證明在我國構(gòu)建檢察機(jī)關(guān)提起公益訴訟制度具有客觀可行性,并為在保障實(shí)現(xiàn)檢察機(jī)關(guān)承擔(dān)法律監(jiān)督職能的前提下,如何使國外檢察機(jī)關(guān)提起公益訴訟的立法經(jīng)驗(yàn)?zāi)転槲宜?提供一條可供借鑒的思路。筆者認(rèn)為,可以在加強(qiáng)理論研究、推動(dòng)公益訴訟的立法進(jìn)程、在特定領(lǐng)域內(nèi)進(jìn)行司法實(shí)踐等三個(gè)方面尋求突破以推進(jìn)我國的公益訴訟建設(shè)。在具體的構(gòu)建過程中,應(yīng)該在訴訟主體、管轄范圍、介入方式、舉證責(zé)任、訴訟風(fēng)險(xiǎn)分配和實(shí)施細(xì)則等方面加以明確和細(xì)化。
[Abstract]:Public interest litigation filed by procuratorial organs as plaintiffs has become the general trend of legislation in various countries in the world. The United States, the United Kingdom, France, Germany, Japan and other countries have respectively established relatively perfect procuratorial organs to institute public interest litigation systems. In the course of the transformation of our market economy, there have been a large number of cases of encroachment on national interests and social public interests, such as the case of the loss of state-owned assets. Environmental and natural resource pollution cases, monopoly cases, irrational use of land cases, and other public cases such as destroying land resources, which violate the interests of the state and the public. However, Due to the absence of the plaintiff system in the procedural law of public interest litigation in our country, As a result, there is a contradiction between the urgent social need to seek judicial protection for the social public interest and the lack of specific legislative provisions on public interest litigation in the current litigation legislation. With the deepening development of the judicial reform and the expansion of procuratorial power in the theoretical circle, Drawing on the legislative examples of public interest litigation filed by foreign procuratorial organs, strengthening the voice of the procuratorial organs' civil public prosecution right in our country, Public interest litigation has been initiated by procuratorial organs from judicial practice to the level of theoretical design and system design. It has been studied deeply and systematically, and a series of systems of public interest litigation filed by procuratorial organs in accordance with the national conditions of our country have been constructed. It has become one of the directions of the reform and development of China's procuratorial system to protect the national interests and the public interests from encroachment. Through the analysis and discussion of path selection, this paper tries to prove the objective feasibility of constructing the public interest litigation system of procuratorial organs in our country, and in order to ensure the procuratorial organs to assume the function of legal supervision. How to make the legislative experience of public interest litigation brought by foreign procuratorial organs be used by us and provide a way of thinking for reference? the author thinks that we can strengthen the theoretical research and promote the legislative process of public interest litigation. In order to promote the construction of public interest litigation in our country, we should make a breakthrough in the three aspects of judicial practice in a specific field. In the concrete construction process, we should have the main body of litigation, the scope of jurisdiction, the way of intervention, the burden of proof, and so on. Litigation risk allocation and implementation of detailed rules and other aspects to be clear and detailed.
