【摘要】：2007年10月30日經(jīng)過皇家御準(zhǔn),英格蘭和威爾士通過了《法律服務(wù)法》(Legal Services Act 2007),為一個(gè)長久而繁瑣的規(guī)制改革畫上了完美的句號。該法的通過不僅為英國的法律服務(wù)市場帶來了福音,也對世界范圍內(nèi)的法律服務(wù)市場具有重要意義。根據(jù)該法的規(guī)定,在英格蘭和威爾士的土壤中將生長出新型律師事務(wù)所。新型律師事務(wù)所解除了傳統(tǒng)律師事務(wù)所對合伙人律師身份和性質(zhì)的限制,允許非律師的自然人和機(jī)構(gòu)成為律師事務(wù)所的合伙人。雖然新型律師事務(wù)所對世界范圍來說都是“新生兒”,然而,這一新生事物的出現(xiàn)可謂眾望所歸,筆者認(rèn)為其對我國律師業(yè)也將產(chǎn)生重要的影響。加入WTO之后,我國的法律服務(wù)市場逐漸對外開放,如何與世界接軌建立高效、規(guī)范的律師事務(wù)所成為我國律師業(yè)發(fā)展的當(dāng)務(wù)之急。在經(jīng)濟(jì)全球一體化和世界法律服務(wù)市場日趨融合的今天,作為法律服務(wù)人口大國,只有緊跟世界法律服務(wù)市場的發(fā)展趨勢,尋求適合我國律師業(yè)發(fā)展的可持續(xù)道路,才能在國際市場上占據(jù)有力地位。 本文圍繞如下問題和邏輯思路展開研究和探索:1.為什么英國會(huì)出現(xiàn)新型律師事務(wù)所?新型律師事務(wù)所是什么?其發(fā)展現(xiàn)狀如何? 2.新型律師事務(wù)所與其他非傳統(tǒng)的律師事務(wù)所或者先進(jìn)制度之間有何聯(lián)系?3.我國法律服務(wù)市場是否有必要引進(jìn)新型律師事務(wù)所?4.我國引進(jìn)新型律師事務(wù)所的相關(guān)制度構(gòu)建。全文共分為四章,此外還有前言和結(jié)論。 第一部分:全方位地向讀者展示英國新型律師事務(wù)所產(chǎn)生的背景、原因和各種相關(guān)規(guī)定,以期讀者能夠?qū)π滦吐蓭熓聞?wù)所概念化。為什么會(huì)在英國的大地上誕生新型律師事務(wù)所是研究新型律師事務(wù)所的出發(fā)點(diǎn); 第二部分:將其他非傳統(tǒng)的律師執(zhí)業(yè)組織形式與新型律師事務(wù)所進(jìn)行比較研究,以期更好地了解新型律師事務(wù)所存在的價(jià)值,以及其對我國的借鑒意義。 第三部分:結(jié)合上文對新型律師事務(wù)所的綜合評述,結(jié)合中國法律服務(wù)市場的發(fā)展?fàn)顩r,試評述其對我國合伙律師事務(wù)所的借鑒意義,并探討中國國情下新型律師事務(wù)所的發(fā)展可能性。 第四部門:針對引進(jìn)非律師合伙人可能會(huì)出現(xiàn)的問題,結(jié)合我國法律服務(wù)市場的發(fā)展?fàn)顩r和現(xiàn)實(shí)國情,力圖對新型律師事務(wù)所引進(jìn)中國進(jìn)行可能的制度構(gòu)建。
[Abstract]:On October 30th 2007, with the Royal Assent, The passage of the legal Services Act 2007 in England and Wales has brought a perfect end to a long and cumbersome regulatory reform that has not only brought good news to Britain's legal services market. It is also of great importance to the worldwide market for legal services, according to the provisions of the Act, New law firms will grow in the soil of England and Wales. New law firms have lifted restrictions on the identity and nature of partners in traditional law firms. Natural persons and institutions that are not lawyers are allowed to become partners in law firms. Although new law firms are "newborns" around the world, the emergence of this new phenomenon is widely expected. After China's entry into WTO, the legal service market of our country will gradually open to the outside world. Standardized law firms have become the top priority for the development of the legal profession in our country. With the globalization of the world economy and the increasing integration of the world legal service market, as a large legal service country with a large population of legal services, it can only keep up with the development trend of the world legal service market. Only by seeking a sustainable road suitable for the development of China's lawyer industry, can it occupy a strong position in the international market. This paper studies and explores the following questions and logical ideas: 1. Why is there a new type of law firm in the UK? What's a new law firm? What is the status quo of its development? 2. What are the links between new law firms and other non-traditional law firms or advanced systems? 3. Is it necessary to introduce new law firms into our legal service market? 4. The related system construction of introducing new law firm in China. The full text is divided into four chapters, in addition, there are preface and conclusion. Part one: to show readers the background, reasons and regulations of the new law firms in the UK. It is hoped that the reader can conceptualize the new law firm. Why the new law firm was born in the United Kingdom is the starting point for the study of the new law firm; In the second part, the author makes a comparative study of other non-traditional lawyer practice organizations and new law firms in order to better understand the value of the new law firms and the significance of their reference to our country. The third part: combined with the comprehensive comments of the new law firms above and the development of the legal service market in China, the author tries to comment on its reference significance to the partnership law firms in China. And discusses the development possibility of the new law firm under the national conditions of China. Section 4th: aiming at the possible problems of introducing non-lawyer partners, combining the development of the legal service market in our country and the actual national conditions, the author tries to construct the possible system for the new law firms to introduce into China.
