【摘要】：遺傳資源給人類帶來了巨大的利益,但是從歷史上、現(xiàn)實中和國際條約的規(guī)定來看,國際社會關(guān)于遺傳資源的法律屬性存在著爭議。遺傳資源是國家主權(quán)管轄下的財產(chǎn),體現(xiàn)了國家對自然資源的永久主權(quán)。具體來說,國家對于遺傳資源既有所有權(quán)和管轄權(quán)的主權(quán)權(quán)利,又有管理、保護(hù)和可持續(xù)利用等方面的國家責(zé)任。就中國而言,中國應(yīng)該采取措施明確本國遺傳資源的法律屬性并對其予以保護(hù),如在國際社會中堅持遺傳資源的永久國家主權(quán)原則,制定專門的關(guān)于遺傳資源的國內(nèi)立法,建立統(tǒng)一高效的遺傳資源的管理體制等等。
[Abstract]:Genetic resources have brought great benefits to human beings, but in the history, in reality and in the provisions of international treaties, the legal attributes of genetic resources are controversial in the international community. Genetic resources are property under the jurisdiction of national sovereignty, which embodies the state's permanent sovereignty over natural resources. Specifically, the state has the sovereign right of ownership and jurisdiction over genetic resources, as well as the state responsibility for the management, protection and sustainable use of genetic resources. For its part, China should take measures to clarify and protect the legal attributes of its genetic resources, such as upholding the principle of permanent national sovereignty over genetic resources in the international community and enacting specific domestic legislation on genetic resources, To establish a unified and efficient management system of genetic resources and so on.
