【摘要】:利率市場(chǎng)化是進(jìn)行金融體制改革的核心和關(guān)鍵,近年來(lái),隨著我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)建設(shè)的不斷深入、國(guó)際經(jīng)濟(jì)一體化以及金融全球化進(jìn)程不斷加快,我國(guó)現(xiàn)存的利率管制體制愈來(lái)愈不適應(yīng)我國(guó)當(dāng)前的經(jīng)濟(jì)發(fā)展要求,其存在的各種弊端也在不斷顯現(xiàn),因此,加快推進(jìn)我國(guó)的利率市場(chǎng)化改革勢(shì)在必行。 早在上個(gè)世紀(jì)九十年代中期,我國(guó)的利率市場(chǎng)化改革就已經(jīng)開(kāi)始,經(jīng)過(guò)十多年的發(fā)展,雖然已經(jīng)取得了一些成就,比如,在貨幣市場(chǎng)和債券市場(chǎng)基本上已經(jīng)實(shí)現(xiàn)了利率市場(chǎng)化,存貸款利率也已經(jīng)實(shí)現(xiàn)了“存款管上限,貸款管下限”的階段性目標(biāo),但是,距離真正實(shí)現(xiàn)利率市場(chǎng)化還有很長(zhǎng)的路要走。因此,在我國(guó)當(dāng)前社會(huì)主義金融體制改革的關(guān)鍵時(shí)刻,利率市場(chǎng)化必須要繼續(xù)深入下去。但是,利率市場(chǎng)化本身就是一個(gè)非常復(fù)雜的過(guò)程,在其不斷深入和發(fā)展的過(guò)程中將會(huì)面臨著各種各樣的風(fēng)險(xiǎn)和困難,這些風(fēng)險(xiǎn)的存在將會(huì)嚴(yán)重干擾我國(guó)利率市場(chǎng)化進(jìn)程的加快,因此,全面的分析這些風(fēng)險(xiǎn)和困難并找出應(yīng)對(duì)這些風(fēng)險(xiǎn)的法律措施就顯得尤為重要了。 本文就是從我國(guó)的利率市場(chǎng)化改革入手,在厘清利率市場(chǎng)化定義的基礎(chǔ)上,全面分析我國(guó)進(jìn)行利率市場(chǎng)化改革的必要性和已經(jīng)取得的階段性成果,并對(duì)利率市場(chǎng)化改革進(jìn)程中將要面臨的各種風(fēng)險(xiǎn)進(jìn)行詳細(xì)分析,繼而從法律層面提出有效的應(yīng)對(duì)之策,以有力地推動(dòng)我國(guó)利率市場(chǎng)化改革不斷深入。本文共分為三個(gè)部分,第一部分主要是對(duì)利率市場(chǎng)化的定義進(jìn)行較為詳細(xì)的界定,以及對(duì)其顯著特征進(jìn)行全面的總結(jié),同時(shí)將利率市場(chǎng)化的意義進(jìn)行較為具體的歸納。第二部分主要從我國(guó)的利率體制現(xiàn)狀入手,分析我國(guó)當(dāng)前的利率市場(chǎng)化改革已經(jīng)取得的顯著成就,并對(duì)利率管制體制的弊端進(jìn)行比較具體、詳細(xì)的說(shuō)明,從而對(duì)我國(guó)繼續(xù)深化利率市場(chǎng)化改革的必要性進(jìn)行較為詳細(xì)的闡述。第三部分主要是應(yīng)用分析和歸納的方法,對(duì)我國(guó)在全面推進(jìn)利率市場(chǎng)化改革的進(jìn)程中所要面對(duì)的各種風(fēng)險(xiǎn)進(jìn)行總結(jié),,通過(guò)對(duì)各種風(fēng)險(xiǎn)逐一進(jìn)行分析,并從法律層面上有針對(duì)性的提出有效的應(yīng)對(duì)之策,以化解我國(guó)在利率市場(chǎng)化改革進(jìn)程中的各種風(fēng)險(xiǎn),最終實(shí)現(xiàn)全面推動(dòng)我國(guó)利率市場(chǎng)化進(jìn)程的進(jìn)一步深化。
[Abstract]:Interest rate marketization is the core and key of financial system reform. In recent years, with the development of socialist market economy in China, the process of international economic integration and financial globalization has been accelerated.The existing interest rate control system in our country is becoming more and more unsuitable for the demand of our country's current economic development, and its various disadvantages are also appearing constantly. Therefore, it is imperative to speed up the reform of interest rate marketization in our country.As early as the mid-1990s, the interest rate marketization reform in China began. After more than a decade of development, although some achievements have been made, for example, interest rate liberalization has basically been achieved in the money market and the bond market.The deposit and loan interest rate has also realized the stage goal of "deposit management upper limit, loan management lower limit", but there is still a long way to go to realize the real marketization of interest rate.Therefore, at the key moment of the reform of the socialist financial system, the marketization of interest rate must continue to go on.However, interest rate marketization itself is a very complex process, in its continuous deepening and development process will face a variety of risks and difficulties, the existence of these risks will seriously interfere with the accelerated process of interest rate marketization.Therefore, comprehensive analysis of these risks and difficulties and find out the legal measures to deal with these risks is particularly important.This article starts with the interest rate marketization reform in our country, on the basis of clarifying the definition of the interest rate marketization, comprehensively analyzes the necessity and the stage achievement of the interest rate marketization reform in our country.This paper also analyzes in detail the various risks that will be faced in the process of interest rate marketization reform, and then puts forward effective countermeasures from the legal level in order to push forward the reform of interest rate marketization in our country.This paper is divided into three parts. The first part is to define the definition of interest rate marketization in detail, and to sum up its significant characteristics, at the same time, to sum up the significance of interest rate marketization more concretely.The second part mainly starts with the present situation of the interest rate system in our country, analyzes the remarkable achievement that our country's current interest rate marketization reform has already obtained, and carries on the quite concrete, detailed explanation to the interest rate control system malpractice.Therefore, the necessity of deepening the reform of interest rate marketization in China is expounded in detail.The third part mainly applies the method of analysis and induction to sum up all kinds of risks that our country has to face in the process of pushing forward the reform of interest rate marketization one by one through the analysis of each kind of risk.In order to resolve the various risks in the process of interest rate marketization reform, the author puts forward some effective countermeasures from the legal aspect, and finally realizes the further deepening of the interest rate marketization process in China.
