【摘要】：隨著海上運(yùn)輸?shù)娜找姘l(fā)展和海上運(yùn)輸活動(dòng)產(chǎn)生影響的日益擴(kuò)大,海上保險(xiǎn)逐 漸向強(qiáng)制化的方向發(fā)展,從而產(chǎn)生了海上強(qiáng)制保險(xiǎn)這一新鮮事物。從海上強(qiáng)制保 險(xiǎn)的產(chǎn)生來(lái)看,它是國(guó)際社會(huì)意識(shí)到海上保險(xiǎn)強(qiáng)制化的必要性在立法上做出的共 同努力。 作為一種新的海上責(zé)任損害賠償機(jī)制,海上強(qiáng)制保險(xiǎn)制度的相關(guān)的理論尚未 發(fā)展起來(lái)。作者從涵義、屬性和范疇?zhēng)讉�(gè)方面進(jìn)行了深入的分析和歸納,認(rèn)為海 上強(qiáng)制保險(xiǎn)是根據(jù)法律規(guī)定而成立的強(qiáng)制實(shí)施于海上運(yùn)輸特定范圍內(nèi)的保險(xiǎn),它 是立法者出于對(duì)海洋環(huán)境利益、航行安全和人身利益的保護(hù)強(qiáng)制適用于船舶污染 損害、海上旅客人身傷亡和沉船沉物打撈領(lǐng)域的責(zé)任保險(xiǎn)。 作為一個(gè)尚不成熟的制度,海上強(qiáng)制保險(xiǎn)在實(shí)踐中的運(yùn)行尚存在很多不明確 之處。筆者從保險(xiǎn)主體、直接訴訟、證書(shū)、責(zé)任限制和扣船等五個(gè)方面一一論證 并提出建議,以理順和解決該制度在運(yùn)行中面臨的現(xiàn)實(shí)難題。 作者結(jié)合本國(guó)海上強(qiáng)制保險(xiǎn)立法實(shí)踐、現(xiàn)實(shí)需要進(jìn)行研究,探求在我國(guó)建立 包括海上運(yùn)輸和水路運(yùn)輸?shù)膹?qiáng)制保險(xiǎn)制度的可行性。海上強(qiáng)制保險(xiǎn)制度在中國(guó)的 建立是歷史的必然,然而,這個(gè)制度何時(shí)得以完善取決于兩個(gè)方面:中國(guó)航運(yùn)業(yè) 的發(fā)展以及相關(guān)立法的健全。只有航運(yùn)經(jīng)濟(jì)的發(fā)展才能使中國(guó)具有足夠的實(shí)力實(shí) 施海上強(qiáng)制保險(xiǎn),并不至于對(duì)航運(yùn)業(yè)形成過(guò)重的包袱;只有立法的完善和基礎(chǔ)理 論的深入研究才能使海上強(qiáng)制保險(xiǎn)成為建立在穩(wěn)定基礎(chǔ)的制度。
