【摘要】：對于審委會參與的案件,從合議庭審理,經(jīng)院庭長監(jiān)督、審委會決定、合議庭制作裁判文書,再回到院庭長簽發(fā),審判權(quán)的運行形成了一個復(fù)合性圓環(huán)。案件審判的多主體參與和主體間的等級關(guān)系是造成審判權(quán)行政化和審判責(zé)任懸置的主要原因。審判權(quán)運行的這一圓環(huán)模式具有典型性,各類案件審判中的行政化現(xiàn)象都可以由之得到說明。審判權(quán)運行機制改革應(yīng)以抽象審判權(quán)和具體審判權(quán)的區(qū)分為基礎(chǔ),以實現(xiàn)"讓審理者裁判、由裁判者負責(zé)"。
[Abstract]:For the cases in which the adjudication committee participates, from the collegial panel hearing, supervising the president of the court, deciding that the collegial panel makes the judgment documents, and then returning to the president of the court to sign the case, the operation of the judicial power forms a compound circle. The multi-subject participation and the hierarchical relationship between the subjects are the main reasons for the judicial power to be administrated and the trial responsibility to be suspended. The circular pattern of judicial power operation is typical, and the administrative phenomenon in all kinds of cases can be explained by it. The reform of the operating mechanism of judicial power should be based on the distinction between abstract jurisdiction and specific jurisdiction, so as to "let the adjudicator judge and be responsible by the adjudicator".
