【摘要】：正根據(jù)刑法第一百七十六條之一的規(guī)定,拒不支付勞動(dòng)報(bào)酬罪的主體是"用人者",包括自然人和用人單位。區(qū)別于機(jī)關(guān)、團(tuán)體和事業(yè)單位,司法實(shí)踐中,由于公司、企業(yè)(包括合伙企業(yè))等經(jīng)濟(jì)組織形式的多元性和實(shí)際運(yùn)營(yíng)的復(fù)雜性,如何準(zhǔn)確界定拒不支付勞動(dòng)報(bào)酬罪的自然人主體,需要進(jìn)一步探析。一、法定代表人不當(dāng)然是"直接負(fù)責(zé)的主管人員"按照刑法第一百七十六條之一第二款的規(guī)定,拒不支付勞動(dòng)報(bào)酬罪的自然人主體包括對(duì)單位
