行政強(qiáng)制執(zhí)行中的代履行制度研究

【摘要】:《行政強(qiáng)制法》出臺(tái)后,代履行作為行政強(qiáng)制執(zhí)行中特殊的執(zhí)行方式首次在我國(guó)正式的立法中被明文規(guī)定。在我國(guó)行政法律制度的完善進(jìn)程中具有重要的里程碑意義,標(biāo)志著我國(guó)行政強(qiáng)制執(zhí)行理論的總體框架進(jìn)一步建立。本文以行政強(qiáng)制執(zhí)行中代履行的基本理論為立足點(diǎn),詳細(xì)闡述我國(guó)行政強(qiáng)制執(zhí)行中代履行制度的法律實(shí)踐,并與域內(nèi)外主要國(guó)家和地區(qū)的相關(guān)制度進(jìn)行比較研究和梳理,,創(chuàng)設(shè)性的提出當(dāng)今我國(guó)代履行制度中存在的不足,最后以此為理論和實(shí)踐的基點(diǎn),指出代履行制度進(jìn)一步完善的創(chuàng)新路徑分析。期望對(duì)日后我國(guó)代履行制度的深層次建構(gòu)提供參考。 本文由三部分組成。在“行政強(qiáng)制執(zhí)行中代履行基本理論”這一部分,重點(diǎn)論述了行政強(qiáng)制執(zhí)行中代履行的基本概念,對(duì)代履行的價(jià)值意義與制度優(yōu)勢(shì)進(jìn)行分析,并闡述了行政強(qiáng)制執(zhí)行中代履行的法律關(guān)系。第二部分為“我國(guó)行政強(qiáng)制執(zhí)行代履行制度與域內(nèi)外主要國(guó)家和地區(qū)的比較及評(píng)析”,首先介紹了代履行制度在我國(guó)的法律實(shí)踐,闡釋梳理了現(xiàn)行《行政強(qiáng)制法》以及其他行政強(qiáng)制法律條文中代履行的相關(guān)法律規(guī)范。其次對(duì)德國(guó)、日本和我國(guó)臺(tái)灣地區(qū)行政法理論與實(shí)踐中代履行制度的歸納介紹以及該法律制度在各國(guó)的特點(diǎn)。最后通過(guò)比較指出我國(guó)行政強(qiáng)制執(zhí)行中代履行制度存在的不足與缺陷,并進(jìn)行評(píng)析,期望對(duì)我國(guó)行政強(qiáng)制執(zhí)行代履行制度進(jìn)一步完善提供參考。第三部分為“行政強(qiáng)制執(zhí)行中代履行制度在實(shí)踐中的完善創(chuàng)新路徑分析”,針對(duì)性的提出完善我國(guó)行政強(qiáng)制代履行的立法建議。首先是確立行政強(qiáng)制執(zhí)行中代履行的范圍。其次是明確行政強(qiáng)制執(zhí)行中代履行的實(shí)施機(jī)關(guān),并設(shè)定了行政強(qiáng)制執(zhí)行中的代履行程序,重點(diǎn)介紹了第三方主體的定位和對(duì)第三方主體的選擇與監(jiān)督。再次是對(duì)進(jìn)一步規(guī)范保障代履行費(fèi)用收取制度提出建議,特別是針對(duì)費(fèi)用收取的范圍、收取的時(shí)間以及代履行費(fèi)用的債權(quán)順位進(jìn)行論述。最后是對(duì)代履行的法律救濟(jì)制度的建立提出完善建議,指出行政強(qiáng)制執(zhí)行中的代履行制度的救濟(jì)可根據(jù)不同的情形分為行政復(fù)議、行政訴訟、國(guó)家賠償三種途徑,并提出具體適用的設(shè)想。
[Abstract]:After the introduction of the Administrative compulsory Law, acting performance, as a special execution mode in the administrative enforcement, is explicitly stipulated in the formal legislation of our country for the first time. It has important milestone significance in the process of perfecting the administrative legal system of our country. It marks the further establishment of the general framework of the theory of administrative enforcement in our country. This paper, based on the basic theory of the performance of the administrative enforcement, expounds in detail the legal practice of the system of administrative compulsory execution in China. And comparative study and combing with the relevant systems of major countries and regions inside and outside the region, creatively put forward the deficiencies in the present system of substitute performance in our country, and finally take this as the basic point of theory and practice. This paper points out the innovation path analysis of the further perfection of the system of acting performance and expects to provide reference for the further construction of the system of acting performance in our country in the future. This paper is composed of three parts. In the part of "the basic Theory of Administrative compulsory execution", this paper focuses on the basic concept of the administrative compulsory execution, and analyzes the value significance and institutional advantages of the agency performance. The second part is about the comparison and evaluation between the system of administrative compulsory performance of our country and the main countries and regions inside and outside the field. Firstly, it introduces the legal practice of the system of acting performance in our country. It explains and combs the relevant legal norms in the current "Administrative compulsory Law" and other provisions of the Administrative compulsory Law. Secondly, to Germany, This paper summarizes and introduces the theory and practice of administrative law in Japan and Taiwan as well as the characteristics of this system in various countries. Finally, it points out the shortcomings and defects of the system of administrative enforcement in China. And make an assessment, The third part is "Analysis of the Innovation and perfection of the Administrative Enforcement system in practice", aiming at improving the administrative performance system of our country. The legislative suggestion of compulsory performance. Firstly, it is to establish the scope of administrative compulsory execution. Secondly, it is to make clear the executive organ of administrative compulsory execution. The procedure of acting performance in administrative enforcement is set up, and the orientation of the third party and the selection and supervision of the third party are emphatically introduced. Again, suggestions are put forward to further standardize the system of ensuring the collection of agency performance fees. In particular, the scope of collection, the time of collection and the order of creditor's rights on behalf of the performance fee are discussed. Finally, some suggestions on the establishment of the legal relief system for acting performance are put forward. It is pointed out that the relief of the system of acting performance in administrative enforcement can be divided into three ways according to different situations: administrative reconsideration, administrative litigation and state compensation.
