【摘要】：城市管理綜合行政執(zhí)法一直是社會(huì)的熱點(diǎn)問題，無論是理論界還是實(shí)務(wù)界都在不斷的探索。雖然取得了一定的效果，解決了在某些領(lǐng)域里交叉執(zhí)法、多頭執(zhí)法的問題，但是問題也接踵而至，實(shí)踐中也出現(xiàn)了很多問題和矛盾，無論在理論界還是實(shí)務(wù)界對(duì)它的質(zhì)疑一直沒有間斷過。對(duì)于其是否屬于行政主體，權(quán)力的范圍以及執(zhí)法人員的編制都存在著諸多的疑問。筆者從城市管理綜合行政執(zhí)法主體的角度出發(fā)，對(duì)其進(jìn)行了探究。文章首先明確了城市管理綜合行政執(zhí)法的內(nèi)涵，闡述了城市管理綜合行政執(zhí)法設(shè)立的依據(jù)、原則特征以及功能。同時(shí)又細(xì)致的分析了城市管理綜合行政執(zhí)法主體目前有哪些的問題存在以及存在這些問題的成因，最后提出了完善城市管理綜合行政執(zhí)法主體的必要性和具體措施。 首先探究了城市管理綜合行政執(zhí)法主體的內(nèi)涵，雖然學(xué)術(shù)界沒有達(dá)成一致的觀點(diǎn)，但是通過比較分析可以得出城市管理綜合行政執(zhí)法主體是指按照法律的規(guī)定設(shè)立的，能夠根據(jù)自己的名義依法行使城市管理綜合行政執(zhí)法權(quán)，履行相應(yīng)的法律義務(wù)，獨(dú)立承擔(dān)相應(yīng)法律后果的行政機(jī)關(guān)，同時(shí)從實(shí)質(zhì)要件和形式要件進(jìn)行分析。其次是對(duì)城市管理綜合行政執(zhí)法主體在日常執(zhí)法過程中現(xiàn)實(shí)存在的問題及成因進(jìn)行了深入的分析。在對(duì)現(xiàn)狀進(jìn)行分析的基礎(chǔ)上深刻認(rèn)識(shí)到城市管理綜合行政執(zhí)法主體存在的問題有：城市管理綜合行政執(zhí)法主體法律地位不明確，組織機(jī)構(gòu)不完善，職權(quán)范圍不確定，運(yùn)行機(jī)制不規(guī)范。并且總結(jié)出其成因在于城市管理綜合行政執(zhí)法主體的相關(guān)法律規(guī)定不全面，執(zhí)法主體的依法行政意識(shí)缺乏。最后分析了完善城市管理綜合行政執(zhí)法主體的必要性。并且提出了幾點(diǎn)建議明確城市管理綜合行政執(zhí)法主體法律地位，完備城市管理綜合行政執(zhí)法組織機(jī)構(gòu)設(shè)置，確立城市管理綜合行政執(zhí)法主體職權(quán)范圍，，規(guī)范城市管理綜合行政執(zhí)法主體運(yùn)行機(jī)制。
[Abstract]:Comprehensive administrative law enforcement of urban management has always been a hot issue in the society. Both theoretical and practical circles are constantly exploring. Although certain results have been achieved, the problems of cross-enforcement and multi-law enforcement in certain fields have been solved. However, the problems followed one after another, and many problems and contradictions appeared in practice, whether in the theoretical or practical circles, there has been no interruption in questioning it. Whether it belongs to the administrative subject or not, There are many questions about the scope of power and the establishment of law enforcement personnel. From the angle of the subject of comprehensive administrative law enforcement of urban management, the author probes into the scope of power and the establishment of law enforcement personnel. At first, the article clarifies the connotation of comprehensive administrative law enforcement of urban management. This paper expounds the basis, principle and function of the establishment of comprehensive administrative law enforcement of urban management. At the same time, it analyzes in detail the problems existing in the subject of comprehensive administrative law enforcement of urban management and the causes of these problems. Finally, it puts forward the necessity and concrete measures to perfect the subject of comprehensive administrative law enforcement of urban management. First of all, it explores the connotation of the subject of comprehensive administrative law enforcement of urban management. Although there is no consensus in academic circles, it can be concluded by comparative analysis that the subject of comprehensive administrative law enforcement of urban management is established in accordance with the provisions of the law. An administrative organ capable of exercising the power of comprehensive administrative law enforcement of urban management in accordance with its own name, fulfilling its corresponding legal obligations, and bearing the corresponding legal consequences independently, At the same time, it analyzes the essential elements and formal elements. Secondly, it makes a deep analysis of the problems and causes existing in the daily law enforcement process of the main body of comprehensive administrative law enforcement of urban management. On the basis of deep understanding of the problems of the subject of comprehensive administrative law enforcement of urban management, the legal status of the subject of comprehensive administrative law enforcement of urban management is not clear. The organization is not perfect, the terms of reference are uncertain, the operating mechanism is not standardized, and the reason is that the relevant laws and regulations of the main body of comprehensive administrative law enforcement of urban management are not comprehensive. Finally, it analyzes the necessity of perfecting the subject of comprehensive administrative law enforcement of urban management, and puts forward several suggestions to clarify the legal status of the subject of comprehensive administrative law enforcement of urban management. It is necessary to set up a comprehensive administrative law enforcement organization for urban management, establish the terms of reference of the main body of comprehensive administrative law enforcement of urban management, and standardize the operating mechanism of the subject of comprehensive administrative law enforcement in urban management.
