【摘要】：患者就醫(yī)時，都希望就診醫(yī)院設(shè)施完備、醫(yī)務(wù)人員醫(yī)術(shù)精湛，從而能早日康復(fù)。但由于醫(yī)療的復(fù)雜性和高風(fēng)險性，條件和水平的參差不齊，有時會發(fā)生醫(yī)療損害，引發(fā)醫(yī)患糾紛。損害發(fā)生時，醫(yī)院、醫(yī)生是否承擔(dān)責(zé)任、承擔(dān)何種責(zé)任等，常成為爭議焦點(diǎn)。醫(yī)療行為系特殊民事行為，其特殊性決定了醫(yī)療損害免責(zé)之規(guī)則應(yīng)符合行業(yè)的獨(dú)特性，有利于醫(yī)療事業(yè)的可持續(xù)發(fā)展。 盡管醫(yī)療糾紛解決方式多樣，但現(xiàn)階段，訴訟仍是解決醫(yī)療損害糾紛的主要形式。在訴訟中，法律規(guī)則和技術(shù)鑒定發(fā)揮著重要作用。制度的不完善使得相似案件出現(xiàn)了地區(qū)和法官個體的差異性。相較之前的法律，我國《侵權(quán)責(zé)任法》對損害責(zé)任之規(guī)定有很大進(jìn)步，但該法和《醫(yī)療事故處理條例》的一些規(guī)定已經(jīng)明顯無法滿足當(dāng)前的現(xiàn)實(shí)需求。 考慮醫(yī)療行為的專業(yè)特性，，有必要實(shí)行醫(yī)療損害的有限免責(zé)。有限免責(zé)有利于醫(yī)療事業(yè)的發(fā)展，能適度降低醫(yī)療行為的風(fēng)險，使醫(yī)療行為理性化�！肚謾�(quán)責(zé)任法》、《醫(yī)療事故處理條例》的免責(zé)規(guī)定具有缺陷，沒有舉證緩和制度，沒有考慮醫(yī)療水平的地區(qū)差異，對免責(zé)事由規(guī)定過于簡單、寬泛，未規(guī)定責(zé)任鑒定制。醫(yī)療免責(zé)舉證責(zé)任的重建應(yīng)考慮引入表見證明理論及限制性舉證責(zé)任倒置理論，需要正確界定醫(yī)療風(fēng)險范圍，適度擴(kuò)大法官自由裁量權(quán)。在法定的免責(zé)事由中，應(yīng)增加患者自甘風(fēng)險和醫(yī)療意外的事由。我國應(yīng)通過司法解釋使醫(yī)療損害責(zé)任的法律規(guī)定更為明確、精細(xì)，強(qiáng)化醫(yī)療損害責(zé)任保險制度，將其作為免責(zé)制度的有益補(bǔ)充，并對醫(yī)療損害賠償額度作出適當(dāng)限制。

Although the medical dispute resolution ways, but at this stage, the main form of litigation is to solve medical malpractice disputes. In the process of litigation, legal rules and technical appraisal plays an important role. The system is not perfect because of the similar cases the differences between regions and individual judges. The earlier law, China's "tort liability law" a lot of progress of damage liability provisions, but the law and regulations of medical malpractice "> Some Provisions have been clearly cannot meet the current needs.
Considering the characteristics of professional medical behavior, it is necessary to implement a limited exemption of medical damage. A limited exemption is conducive to the development of medical cause, risk can moderately reduce the medical behavior, rational behavior. The medical tort liability law ", has defects of exemption" Regulations on handling medical accidents ", without the burden of mitigation system there is no difference between the medical level in consideration, too simple, provisions on the exemption of responsibility identification system wide, not specified. The exemption of burden of proof of medical reconstruction should consider the introduction of apparent proof theory and the limit of the burden of proof theory, to correctly define the scope of medical risk, moderate expansion of the discretion of the judge in legal. Excusatio, should increase with the assumption of risk and causes of medical accidents. China's judicial interpretation of the legal provisions of the liability of medical damage is more clear, fine, strengthen the medical liability insurance The insurance system will be used as a beneficial supplement to the exemption system and to make appropriate restrictions on the amount of compensation for medical damage.
