【摘要】:目前打車軟件的運(yùn)用十分流行,這種約車新形式服務(wù)正在悄然改變?nèi)藗儌鹘y(tǒng)打車模式,它的新穎性、創(chuàng)新性、高效性以及便利性為人們的出行提供了巨大的方便,同時(shí)也帶來(lái)了打車軟件的快速發(fā)展。但是,新生事物的出現(xiàn)總具有其兩面性。打車軟件在給人們帶來(lái)便利快捷的同時(shí),也存在著一些富有爭(zhēng)議性情況。正是這些爭(zhēng)議性問(wèn)題使得人們對(duì)打車軟件的出現(xiàn)產(chǎn)生一些疑慮。例如,出租車司機(jī)利用軟件中加價(jià)功能隨意向乘客加價(jià)或者假借提前約車對(duì)乘客拒載,出租車司機(jī)和乘客存在相互“失約”等失信現(xiàn)象。因此,國(guó)內(nèi)一些地方開始對(duì)這類打車軟件進(jìn)行嚴(yán)格限制甚至叫停,使得打車軟件的發(fā)展陷入迷茫狀態(tài)。但是新事物的出現(xiàn)肯定會(huì)遇到種種阻礙,難免要與人們固有的社會(huì)意識(shí)形態(tài)發(fā)生碰撞,新事物要想被人們接受,就一定要有與人類社會(huì)相磨合的過(guò)程。我們對(duì)打車軟件應(yīng)該建立正確與積極的態(tài)度,積極引導(dǎo)和鼓勵(lì)這種創(chuàng)新模式的出現(xiàn)和發(fā)展,從而促進(jìn)科技進(jìn)步和社會(huì)發(fā)展。針對(duì)打車軟件帶來(lái)的一系列問(wèn)題應(yīng)該積極采取相應(yīng)措施加以糾正和改善,在打車軟件尚未成熟的情況下,政府應(yīng)該驅(qū)動(dòng)市場(chǎng),采取引導(dǎo)的方式使其在現(xiàn)有的法律法規(guī)約束下健康發(fā)展。本文從打車軟件行政法規(guī)制的角度進(jìn)行研究,深刻分析打車軟件的產(chǎn)生、發(fā)展、政府規(guī)制現(xiàn)狀以及其存在的一系列問(wèn)題,結(jié)合現(xiàn)實(shí)生活中的相關(guān)案例,從行政法基本原則、行政壟斷以及行政許可的法律視角對(duì)打車軟件行政法規(guī)制進(jìn)行剖析。并提出切實(shí)可行的法律對(duì)策,如明確政府監(jiān)管范圍,遵守行政法律原則,規(guī)范行政許可制度,完善運(yùn)營(yíng)定價(jià)機(jī)制等六方面進(jìn)行論述。最后希望本文能夠?yàn)榇蜍囓浖袌?chǎng)的健康發(fā)展,為行政機(jī)關(guān)的合理監(jiān)管,為交通法治的建設(shè)提供綿薄之力。
[Abstract]:At present, the use of ride-hailing software is very popular. This new form of ride-hailing service is quietly changing the traditional ride-hailing mode. Its novelty, innovation, efficiency and convenience provide great convenience for people to travel. At the same time, it also brought about the rapid development of ride-hailing software. However, the emergence of new things always has its two sides. Ride-hailing software brings convenience and speed to people at the same time, There are also controversial situations. It is these controversial issues that raise some doubts about the emergence of ride-hailing software. For example, Taxi drivers make use of the function of toll increase in the software to increase their charges to passengers at will or refuse to take passengers on the pretext of chartering a car in advance, so the taxi drivers and passengers have the phenomenon of "breaking their promises" with each other. Some parts of the country began to restrict or even stop this kind of ride-hailing software, making the development of ride-hailing software in a state of confusion. But the emergence of new things will certainly encounter various obstacles. It is inevitable to collide with people's inherent social ideology. If new things are to be accepted, there must be a process of running in line with human society. We should establish a correct and positive attitude towards ride-hailing software. Actively guide and encourage the emergence and development of this innovative model, thereby promoting scientific and technological progress and social development. In view of the series of problems caused by the ride-hailing software, we should actively take appropriate measures to correct and improve it. Under the condition that the ride-hailing software is not mature, the government should drive the market and adopt the guiding way to make it develop healthily under the restriction of the existing laws and regulations. This paper deeply analyzes the emergence, development, the current situation of government regulation and a series of problems existing in taxi hailing software, combining with the relevant cases in real life, from the basic principles of administrative law. From the legal perspective of administrative monopoly and administrative license, this paper analyzes the system of administrative regulations and rules of taxi hailing software, and puts forward some practical legal countermeasures, such as clarifying the scope of government supervision, observing the principles of administrative law, standardizing the system of administrative license. Finally, it is hoped that this paper can provide a modest force for the healthy development of the taxi software market, for the rational supervision of the administrative organs and for the construction of the traffic rule of law.
