面向社會(huì)政策的行政法學(xué)進(jìn)路:視角與方法

【摘要】：社會(huì)政策作為關(guān)涉公民福祉的重要領(lǐng)域,與行政法學(xué)上給付行政具有很多共通之處。社會(huì)政策體現(xiàn)了國家與社會(huì)的勾連,其變動(dòng)也為行政法學(xué)提出了新的研究課題。同時(shí),在具體的社會(huì)政策執(zhí)行時(shí),也需要行政法的保障。在日漸重視社會(huì)政策的中國當(dāng)下,行政法學(xué)研究者也應(yīng)沿著妥當(dāng)?shù)倪M(jìn)路才能對(duì)這一問題進(jìn)行深入探究。這要求行政法學(xué)引入需求視角,關(guān)注社會(huì)政策的執(zhí)行與法效果,進(jìn)而考察社會(huì)政策中的多元法律關(guān)系與主體,并借助公私混合視角加以分析。
[Abstract]:Social policy, as an important field involving the well-being of citizens, has a lot in common with administrative law. Social policy embodies the connection between the state and the society, and its changes have also put forward new research topics for administrative law. At the same time, when the specific social policy is implemented, it also needs the guarantee of administrative law. In the present period of China's policy, the administrative law researchers should also follow the appropriate approach to explore this problem. This requires administrative law to introduce the demand perspective, pay attention to the implementation of social policy and the effect of law, and then examine the multiple legal relations and subjects in social policy, and analyze it with the help of a mixed public and private perspective.
