【摘要】：當(dāng)前，隨著我國經(jīng)濟(jì)迅猛發(fā)展、綜合國力不斷增強(qiáng)，以及城鄉(xiāng)一體化進(jìn)程加快，越來越多的農(nóng)村土地以各種形式被征收，因此引發(fā)的社會矛盾也日漸突出。造成這些矛盾的因素是多方面的，但是農(nóng)民知情權(quán)的缺失是一個(gè)不容忽視的原因：由于農(nóng)民對于集體土地征收毫不知情或所知有限，直接導(dǎo)致參與權(quán)和監(jiān)督權(quán)缺失，加之公共利益界定不清、安置補(bǔ)償不合理等原因，，農(nóng)民的各項(xiàng)權(quán)益受到不同程度的侵害；而由于農(nóng)民文化水平普遍偏低，法律意識普遍薄弱，維權(quán)能力普遍不足，在權(quán)益受到侵害后無力伸張或是采用非理性的方式維權(quán)，最終導(dǎo)致矛盾日益尖銳。 集體土地征收中農(nóng)民知情權(quán)是指農(nóng)民知曉、了解與集體土地征收相關(guān)的信息的權(quán)利，是農(nóng)民在集體土地征收中實(shí)現(xiàn)參與權(quán)和監(jiān)督權(quán)的前提與保證，是保障農(nóng)民各項(xiàng)合法權(quán)益的關(guān)鍵，是集體土地征收問題下的重要一環(huán)。 我國現(xiàn)行法律制度在保護(hù)集體土地征收中農(nóng)民知情權(quán)方面存在很多不足：相關(guān)法律法規(guī)可操作性不強(qiáng)，監(jiān)督機(jī)制不健全，農(nóng)民知情權(quán)受到侵害后的法律救濟(jì)制度不完善等，實(shí)踐中，農(nóng)民的知情權(quán)常常被忽視或肆意踐踏。本文從知情權(quán)入手研究農(nóng)民在集體土地征收中的權(quán)益保護(hù)，一定程度上拓寬了相關(guān)領(lǐng)域的研究視野，對農(nóng)民權(quán)益保護(hù)的薄弱環(huán)節(jié)進(jìn)行了充實(shí)，同時(shí)也對進(jìn)一步完善我國集體土地征收制度有所助益，具有必要的學(xué)術(shù)價(jià)值和無可爭辯的現(xiàn)實(shí)意義。文章共分為四個(gè)章節(jié)： 第一部分，緒論，闡明選題的背景及研究意義，綜述國內(nèi)外前期研究文獻(xiàn)，論述本文的研究方法、內(nèi)容和結(jié)構(gòu)； 第二部分，對知情權(quán)和集體土地征收中的知情權(quán)的概念解讀，引出知情權(quán)這一概念，分析其性質(zhì)和特點(diǎn)，通過對我國集體土地征收制度的研究，梳理這一過程中農(nóng)民所具有的知情權(quán)； 第三部分，介紹我國集體土地征收現(xiàn)狀，在此基礎(chǔ)上，找出集體土地征收中農(nóng)民知情權(quán)保護(hù)暴露的問題并從不同角度分析其原因； 第四部分，借鑒國外在土地征收立法上對所有權(quán)人權(quán)利保護(hù)的做法，以及我國部分地區(qū)的先進(jìn)做法，結(jié)合我國農(nóng)村、農(nóng)民的特點(diǎn)和現(xiàn)狀以及土地征收的實(shí)踐背景，提出完善集體土地征收中農(nóng)民知情權(quán)法律保護(hù)的個(gè)人設(shè)想。
[Abstract]:At present, with the rapid development of China's economy, the strengthening of comprehensive national strength and the accelerated process of urban-rural integration, more and more rural land is expropriated in various forms, so the social contradictions are becoming more and more prominent. The factors that cause these contradictions are manifold, but the lack of farmers' right to know is a reason that can not be ignored. The peasants' rights and interests are violated in different degrees because of the peasants' lack of knowledge of collective land or limited knowledge, the lack of participation and supervision, the unclear definition of public interests and the unreasonable compensation for resettlement, and because of the low level of farmers' cultural level, the weak legal consciousness and the ability to maintain rights. Over and over, after the rights and interests are infringed, it is unable to extend or adopt an irrational way of safeguarding rights, which eventually leads to increasingly sharp contradictions.
The peasants' right to know in the collection of collective land refers to the rights of farmers to know and understand the information related to collective land expropriation. It is the premise and guarantee for farmers to realize the right to participate and supervise in the collection of collective land. It is the key to guarantee the legitimate rights and interests of farmers and an important part of the collection of collective land.
In the current legal system of China, there are many shortcomings in the protection of the peasants' right to know in the collection of collective land, such as the poor operability of the relevant laws and regulations, the imperfect supervision mechanism and the imperfect legal relief system after the peasants' right to know. In practice, the peasants' right to know is often ignored or trampled wantonly. The hand study of farmers' rights protection in collective land expropriation has widened the research field of the related fields to a certain extent, enriches the weak links of the protection of farmers' rights and interests, and also helps to further improve the system of collective land collection in our country. It has the necessary academic value and undisputed practical significance. There are four chapters:
The first part, introduction, clarifies the background and research significance of the topic, reviews the previous research literature at home and abroad, discusses the research methods, content and structure of this paper;
The second part, the concept of the right to know in the right to know and the collective land expropriation, lead to the concept of the right to know, analyze its nature and characteristics, through the study of the system of collective land expropriation in China, to comb the right to know the peasants in this process;
The third part introduces the current situation of collective land expropriation in China, and on this basis, finds out the problems of the protection and exposure of farmers' right to know in collective land expropriation and analyses the reasons from different angles.
The fourth part, drawing on the practice of protecting the rights of the owner in the land expropriation legislation, and the advanced practice in some areas of our country, combined with the characteristics and present situation of the peasants and the practical background of the land expropriation in our country, and puts forward the personal idea of improving the legal protection of the farmers' right to know the knowledge of the land in the collection of collective land.
