政府和社會資本合作立法三論

【摘要】：財政部新近起草了《中華人民共和國政府和社會資本合作法(征求意見稿)》,意在將PPP項目的運作加以統(tǒng)一規(guī)范。結(jié)合已有的PPP實踐來看,PPP統(tǒng)一立法應(yīng)注意明確以下三方面內(nèi)容:一是在立法中消除PPP與特許經(jīng)營內(nèi)涵界定上的分歧,明確特許經(jīng)營是PPP的一種主要形式;二是在立法中明確不同類型的PPP項目的準入規(guī)則,實現(xiàn)PPP立法與相關(guān)法律之間的協(xié)調(diào)與銜接;三是通過企業(yè)誠信體系的建立、新型懲戒手段的配置、違約追究機制的確立等措施加強事中事后監(jiān)管,助推PPP的有效開展。
[Abstract]:The Ministry of Finance has recently drafted the Law on Cooperation between the Government and Social Capital of the people's Republic of China (draft for comments), which is intended to unify and standardize the operation of the PPP project. According to the existing practice of PPP, we should pay attention to the following three aspects: first, to eliminate the difference between PPP and franchise in legislation, and to make it clear that franchise is one of the main forms of PPP; Second, make clear the admission rules of different types of PPP projects in legislation, realize the coordination and convergence between PPP legislation and related laws; third, through the establishment of enterprise integrity system, the allocation of new disciplinary means, The establishment of default investigation mechanism and other measures to strengthen the post-supervision and promote the effective development of PPP.
