我國食品安全法律規(guī)制問題研究

【摘要】: 民以食為天,食品關(guān)系到人類的生存和身體健康。隨著經(jīng)濟(jì)全球化和國際食品貿(mào)易的日益擴(kuò)大,危及人類健康、生命安全的重大食品安全事件屢屢發(fā)生,如1999年比利時等國發(fā)生的二惡英事件、2001年歐洲爆發(fā)的口蹄疫等。經(jīng)過多年的發(fā)展,我國在滿足食品數(shù)量需求的同時,食品質(zhì)量卻存在著嚴(yán)重不足,食品安全形勢十分嚴(yán)峻,如近幾年爆發(fā)的“非典型性肺炎”、“禽流感”和“蘇丹紅”事件等。食品安全問題日趨成為中國乃至全世界倍受關(guān)注的問題。 本文試圖從法律規(guī)制的角度,對我國的食品安全問題進(jìn)行深入探討和分析,并提出了完善我國食品安全法律規(guī)制的建議。全文共分四個部分: 第一部分,概要介紹了國內(nèi)外食品安全的現(xiàn)狀,并簡要分析了我國食品安全問題產(chǎn)生的原因。 第二部分,通過介紹國外食品安全法律規(guī)制的現(xiàn)狀,提出要借鑒國際組織與國外發(fā)達(dá)國家如美國、德國、加拿大、日本關(guān)于食品安全法律規(guī)制的先進(jìn)經(jīng)驗,以使我國食品安全的法制建設(shè)更加完善。 第三部分,就我國食品安全法律規(guī)制的現(xiàn)狀進(jìn)行了分析。我國政府對食品安全問題非常重視,經(jīng)過多年努力,目前已初步形成了食品安全法律體系的基本框架,但同發(fā)達(dá)國家和國際社會相比較,尚存在一定的不足,如法律不夠完善、內(nèi)部協(xié)調(diào)性差,相關(guān)法律制度不健全,法律法規(guī)的處罰力度不夠等問題。 第四部分,提出了完善我國食品安全法律規(guī)制的建議。包括:我國食品安全立法應(yīng)堅持的原則和建立的制度;保障我國食品安全的具體法律對策。 總之,隨著經(jīng)濟(jì)全球化和國際食品貿(mào)易的發(fā)展,食品安全問題已成為當(dāng)今世界共同關(guān)注的問題,食品安全法律的健全和完善在世界各國都被作為一項戰(zhàn)略性任務(wù)、基礎(chǔ)性工作給予高度重視,我國必須加強(qiáng)與國際合作,共同探討食品安全的治理經(jīng)驗,不斷完善我國食品安全法律制度,以更好的保護(hù)人民的身體健康、維護(hù)社會穩(wěn)定,并促進(jìn)我國對外貿(mào)易的發(fā)展。
[Abstract]:People take food as the day, food is related to the survival and health of human beings. With the globalization of economy and the expansion of international food trade, important food safety incidents, such as the dioxin incident in Belgium in 1999 and the foot-and-mouth disease outbreak in Europe in 2001, have occurred frequently. After years of development, while meeting the demand for food quantity in China, there are serious deficiencies in food quality, and the food safety situation is very serious, such as the outbreak of "atypical pneumonia" in recent years. "Avian Influenza" and "Sudan Red" incident. The problem of food safety is becoming more and more important in China and the whole world. This paper attempts to discuss and analyze the food safety problems in China from the angle of legal regulation, and puts forward some suggestions to perfect the legal regulation of food safety in China. This paper is divided into four parts: the first part introduces the current situation of food safety at home and abroad, and briefly analyzes the causes of food safety problems in China. In the second part, by introducing the current situation of food safety regulation in foreign countries, the author proposes to draw lessons from the advanced experiences of international organizations and developed countries such as the United States, Germany, Canada and Japan on the legal regulation of food safety. In order to make our country food safety legal system construction more perfect. The third part analyzes the current situation of food safety regulation in China. Our government attaches great importance to the problem of food safety. After many years of efforts, the basic framework of the food safety legal system has been preliminarily formed. However, compared with the developed countries and the international community, there are still some shortcomings, such as inadequate laws. The internal coordination is poor, the related legal system is not perfect, the punishment of laws and regulations is not strong enough and so on. The fourth part, has proposed the consummation our country food safety legal regulation suggestion. It includes: the principle and system that should be adhered to in the food safety legislation of our country, and the concrete legal countermeasures to ensure the food safety in our country. In short, with the development of economic globalization and international food trade, food safety has become a common concern in the world today. The perfection and perfection of food safety laws are regarded as a strategic task in all countries in the world. We must strengthen our cooperation with the international community, jointly explore the experience of food safety governance, and constantly improve our food safety legal system in order to better protect the people's health and maintain social stability. And promote the development of China's foreign trade.
