【摘要】：現(xiàn)代行政是19世紀(jì)自由法治國家行政與20世紀(jì)社會福利國家行政的雙重結(jié)合,國家任務(wù)不僅大幅擴張,還形成了行政主體多元化與治理方式多樣化的格局。以控制行政權(quán)為目的,以司法審查為核心的規(guī)范主義傳統(tǒng)不足以應(yīng)對這一革新,行政法向功能主義發(fā)展。但以洞察行政內(nèi)部,關(guān)注行政目標(biāo)實現(xiàn)而著稱的功能主義無法達成新的合法性基礎(chǔ)而始終作為一種異端風(fēng)格存在。因此,促進規(guī)范主義與功能主義的融合并發(fā)展新的行政法研究范式成為有必要的嘗試。面向行政的行政法即是這樣一種展開,以開放的公共行政為主要研究對象,重塑以行政任務(wù)為導(dǎo)向的授權(quán)制度,完善多元公共主體的組織構(gòu)架,形成信任權(quán)力前提下嚴(yán)苛的程序控制,建設(shè)以結(jié)果歸責(zé)為核心的公平責(zé)任機制,發(fā)揮行政法除控制以外的規(guī)范、引導(dǎo)、保障功能,促使以司法為中心的行政法向以行政過程為中心的行政法轉(zhuǎn)向。
[Abstract]:Modern administration is the dual combination of the free rule of law state administration in the 19th century and the social welfare state administration in the 20th century. The national task is not only greatly expanded, but also forms the pattern of diversification of administrative subjects and governance methods. For the purpose of controlling administrative power and judicial review as the core of normative tradition, the tradition of norms is not enough to deal with this innovation, and administrative law develops to functionalism. However, functionalism, which is famous for its insight into the interior of administration and paying attention to the realization of administrative goals, can not achieve a new basis of legitimacy and always exists as a heresy. Therefore, it is necessary to promote the integration of normalism and functionalism and develop a new paradigm of administrative law research. Administrative law facing administration is such a kind of development, taking open public administration as the main research object, reshaping the authorization system guided by administrative task, and perfecting the organizational structure of pluralistic public subjects. To form strict procedural control under the premise of trust power, to build a fair responsibility mechanism with result imputation as the core, and to give full play to the norms, guidance and guarantee functions of administrative law in addition to control. Promote the judicial as the center of administrative law to administrative process-centered administrative law.
