【摘要】:隨著我們對(duì)于知識(shí)產(chǎn)權(quán)認(rèn)識(shí)的不斷深入,對(duì)于知識(shí)產(chǎn)權(quán)資源有效的利用,已經(jīng)是一個(gè)越來越重要的問題,目前知識(shí)產(chǎn)權(quán)質(zhì)押貸款是可以利用知識(shí)產(chǎn)權(quán)的資源性的一個(gè)新型渠道。知識(shí)產(chǎn)權(quán)質(zhì)押貸款是指知識(shí)產(chǎn)權(quán)權(quán)利人通過將其所擁有的知識(shí)產(chǎn)權(quán)出質(zhì),以作為其本人或者其他人的借款擔(dān)保,進(jìn)而從貸款人處獲取貸款的融資行為。從發(fā)展現(xiàn)狀來看,我國的知識(shí)產(chǎn)權(quán)質(zhì)押貸款的主要需求對(duì)象是國內(nèi)的固定資產(chǎn)少,,信用低,自有資金薄弱的中小型高科技企業(yè)。目前,我國知識(shí)產(chǎn)權(quán)質(zhì)押貸款看似蓬勃發(fā)展,但是其實(shí)其中的風(fēng)險(xiǎn)還是不少的,包括法律風(fēng)險(xiǎn)、經(jīng)濟(jì)風(fēng)險(xiǎn)、變現(xiàn)風(fēng)險(xiǎn)、交易風(fēng)險(xiǎn)、政府參與度過高導(dǎo)致的風(fēng)險(xiǎn)。為了讓知識(shí)產(chǎn)權(quán)質(zhì)押貸款的發(fā)展穩(wěn)定繁榮,我們探究了它的風(fēng)險(xiǎn)產(chǎn)生的根本原因,包括知識(shí)產(chǎn)權(quán)質(zhì)押立法體系不完善,登記制度不完善,評(píng)估交易制度不完善,知識(shí)產(chǎn)權(quán)不易控制的問題。針對(duì)這些問題,我們提出了相應(yīng)的完善辦法。希望可以通過這些解決辦法,我們可以解除商業(yè)銀行對(duì)于知識(shí)產(chǎn)權(quán)質(zhì)押貸款的憂慮和謹(jǐn)慎,積極的參與到這些貸款活動(dòng)中。這樣不但支持了科技型中小企業(yè)的發(fā)展,幫助他們解決發(fā)展的資金來源。而且對(duì)于商業(yè)銀行來說,提升了商業(yè)銀行的業(yè)務(wù)能力,拓展了商業(yè)銀行的業(yè)務(wù)范圍,降低銀行業(yè)貸款同質(zhì)化的風(fēng)險(xiǎn)。從整體上來說也提升我國的綜合國力。也為我國的發(fā)展做了貢獻(xiàn)。
[Abstract]:With the deepening of our knowledge of intellectual property, the effective use of intellectual property resources has become an increasingly important issue. At present, intellectual property mortgage loan is a new way to utilize intellectual property resources. Intellectual property mortgage loan refers to the financing behavior that the intellectual property right holder obtains the loan from the lender by pledge the intellectual property right in order to guarantee the loan for himself or others. From the current situation of development, the main demand for intellectual property mortgage loans in China is small and medium-sized high-tech enterprises with small fixed assets, low credit and weak own funds. At present, China's intellectual property mortgage loan seems to be booming, but in fact, there are still many risks, including legal risk, economic risk, liquidity risk, transaction risk, the risk caused by excessive government participation. In order to make the development of intellectual property mortgage loan stable and prosperous, we have explored the root causes of its risk, including imperfect legislation system of intellectual property pledge, imperfect registration system, imperfect evaluation and transaction system. Intellectual property rights are difficult to control. In view of these problems, we put forward the corresponding consummation method. We hope that through these solutions, we can relieve the commercial banks of the intellectual property mortgage loan worries and caution, actively participate in these lending activities. This not only supports the development of technology-based small-and-medium-sized enterprises, to help them solve the source of development funds. And for commercial banks, it improves the business ability of commercial banks, expands the business scope of commercial banks, and reduces the risk of homogenization of bank loans. On the whole, it also promotes the overall national strength of our country. It has also contributed to the development of our country.
