【摘要】：中藥被世界逐步認(rèn)可并深度開(kāi)發(fā),但我國(guó)的中藥產(chǎn)業(yè)卻同時(shí)失去國(guó)內(nèi)國(guó)際2個(gè)市場(chǎng),中藥傳統(tǒng)知識(shí)保護(hù)不力是一重要原因。目前中藥傳統(tǒng)知識(shí)保護(hù)的研究主要有借用西方知識(shí)產(chǎn)權(quán)制度、創(chuàng)設(shè)專門(mén)制度和采用技術(shù)手段保護(hù)3個(gè)方向,沒(méi)有研究中藥傳統(tǒng)知識(shí)的本質(zhì)和中藥傳統(tǒng)知識(shí)向產(chǎn)品轉(zhuǎn)化的路徑,也忽視了經(jīng)濟(jì)背景、政治環(huán)境變化與中藥傳統(tǒng)知識(shí)保護(hù)之間的相互影響。所以研究應(yīng)轉(zhuǎn)向深入認(rèn)識(shí)中藥傳統(tǒng)知識(shí)本質(zhì),調(diào)研"新常態(tài)"下的保護(hù)現(xiàn)狀,尋找符合"依法治國(guó)"理念的保護(hù)策略。
[Abstract]:Traditional Chinese medicine has been gradually recognized and developed in the world, but the traditional Chinese medicine industry in China has lost both domestic and international markets at the same time. The weak protection of traditional Chinese medicine knowledge is an important reason. At present, the research on the protection of traditional Chinese medicine knowledge mainly includes three directions: borrowing the western intellectual property right system, creating special system and adopting technical means to protect traditional Chinese medicine. There is no research on the essence of traditional Chinese medicine knowledge and the path of traditional Chinese medicine knowledge transforming into product. It also ignores the interaction between the economic background, the change of political environment and the protection of traditional Chinese medicine knowledge. Therefore, the research should turn to deeply understand the essence of traditional Chinese medicine knowledge, investigate the current situation of protection under the "new normal", and seek protection strategies in line with the concept of "governing the country by law".
