【摘要】： 20世紀80年代以來,隨著改革開放不斷深入和社會主義市場經(jīng)濟體制的逐步確立,我國政治、經(jīng)濟、文化和社會發(fā)生巨大變化,治安形勢也發(fā)生了重大變化,經(jīng)濟犯罪進入高發(fā)期,其科技程度、專業(yè)性、預謀性和智能化越來越高,增長速度明顯高于其他刑事犯罪案件,其中大要案件尤為突出,2006年全國公安機關共立經(jīng)濟犯罪案件8.1萬起,破案6.5萬起,挽回經(jīng)濟損失人民幣190.5億元,經(jīng)濟犯罪嚴重危及社會穩(wěn)定和國家安全。如何有效地預防和打擊經(jīng)濟犯罪,遏制經(jīng)濟犯罪高發(fā)態(tài)勢已經(jīng)迫在眉睫。 本文通過對我國當前經(jīng)濟犯罪現(xiàn)狀分析,深層次、多角度剖析經(jīng)濟犯罪成因,有針對性提出預防和打擊對策,特別重點論述了刑事方面的對策。公安機關作為打擊經(jīng)濟犯罪的重要職能部門,承擔了絕大部分經(jīng)濟犯罪案件的偵查職能。本文從公安機關打擊經(jīng)濟犯罪實戰(zhàn)角度出發(fā),對比研究西文發(fā)達國家先進經(jīng)驗,從建立主動進攻機制入手,就如何樹立“情報信息主導經(jīng)濟犯罪偵查”新理念,構(gòu)建現(xiàn)代經(jīng)濟犯罪偵查模式做出詳細闡述,以期進一步豐富預防和打擊經(jīng)濟犯罪的內(nèi)容,為更加有效預防和打擊經(jīng)濟犯罪提供有益參考。 本文分為三章,包括三個部分內(nèi)容: 第一部分:前言,屬于研究綜述篇。本篇全面系統(tǒng)介紹本論文的研究背景、研究目的及研究對象,對國外、國內(nèi)經(jīng)濟犯罪研究的理論現(xiàn)狀進行了綜述,指明了全文的寫作思路、研究方法、研究框架和各部分內(nèi)容,指出本文的創(chuàng)新與不足之處。 第二部分:第一章、第二章,屬于現(xiàn)狀分析篇。本篇介紹了我國當前經(jīng)濟犯罪的現(xiàn)狀、發(fā)展趨勢和成因,回顧我國經(jīng)濟犯罪研究與整治的發(fā)展歷程,揭示當前經(jīng)濟犯罪的高發(fā)態(tài)勢,預防和打擊經(jīng)濟犯罪的嚴峻形勢。 第三部分:第三章,屬于理論實證篇,這部分是本文的重點。通過前面章節(jié)的研究,指出我國由于正處在社會轉(zhuǎn)型期,誘發(fā)經(jīng)濟犯罪的因素大量存在,導致經(jīng)濟犯罪持續(xù)高發(fā)態(tài)勢。在這部分,本文針對我國經(jīng)濟犯罪的現(xiàn)實特征、發(fā)展趨勢及誘發(fā)因素,提出預防和打擊經(jīng)濟犯罪的對策建議,特別從刑事對策方面加以重點闡述,從立法對策和司法對策兩個角度提出建設性意見。并從公安機關打擊經(jīng)濟犯罪實戰(zhàn)角度出發(fā),借鑒國外先進偵查理念和偵查模式,探索建立主動進攻機制,樹立“情報信息主導經(jīng)濟犯罪偵查”新理念,構(gòu)建現(xiàn)代經(jīng)濟犯罪偵查模式,提高打擊經(jīng)濟犯罪的精確度,保證公安機關更好地履行預防和打擊經(jīng)濟犯罪的職責。
[Abstract]:Since 1980s, with the deepening of reform and opening up and the gradual establishment of the socialist market economic system, great changes have taken place in our country's politics, economy, culture and society, and the public security situation has also undergone major changes. When economic crimes enter a period of high incidence, their scientific and technological level, professionalism, premeditated nature and intelligence are getting higher and higher, and the growth rate is obviously higher than that of other criminal cases. In 2006, the public security organs throughout the country set up 81,000 cases of economic crimes, 65,000 cases were solved, and 19.05 billion yuan worth of economic losses were recovered. Economic crime seriously endangers social stability and national security. How to effectively prevent and combat economic crime and curb the high incidence of economic crime is imminent. By analyzing the present situation of economic crime in our country, this paper analyzes the causes of economic crime from deep level and multi-angle, and puts forward some countermeasures to prevent and combat it. As an important functional department to fight against economic crime, the public security organ has assumed the investigation function of most economic crime cases. This paper sets out from the angle of actual combat against economic crime by public security organ. By contrasting the advanced experiences of the western developed countries, starting with the establishment of the active attack mechanism, this paper expounds in detail how to establish the new concept of "intelligence and information leading economic crime investigation" and how to construct the modern economic crime investigation mode. In order to further enrich the content of preventing and combating economic crime, and provide a useful reference for more effective prevention and combat of economic crime. This paper is divided into three chapters, including three parts:. The first part: preface, belongs to the research summary. This article comprehensively and systematically introduces the research background, the research purpose and the research object, has carried on the summary to the foreign, domestic economic crime research theory present situation, This paper points out the ideas, research methods, research framework and contents of the thesis, and points out the innovation and deficiency of this paper. The second part: the first chapter, the second chapter, belongs to the present situation analysis chapter. This chapter introduces the present situation, the development tendency and the cause of formation of our country's current economic crime, reviews the development course of our country's economic crime research and the rectification, To reveal the current situation of high incidence of economic crime, to prevent and crack down on the grim situation of economic crime. The third part: chapter three, belongs to the theory demonstration chapter, this part is the focal point of this article. Through the previous chapter research, points out that our country is in the social transition period, the factor which induces the economic crime exists in large quantities. In this part, aiming at the realistic characteristics, developing trend and inducing factors of economic crime in our country, the author puts forward countermeasures and suggestions to prevent and crack down on economic crime, especially from the aspect of criminal countermeasures. This paper puts forward constructive suggestions from the angle of legislative countermeasures and judicial countermeasures, and from the angle of actual combat against economic crimes by public security organs, draws lessons from foreign advanced investigation concepts and investigation models, and explores the establishment of active attack mechanism. To establish a new concept of "information information leading economic crime investigation", to construct modern economic crime investigation mode, to improve the accuracy of cracking down on economic crime, and to ensure the public security organ to perform its duty of preventing and cracking down economic crime better.
