【摘要】：作為世界通行的反腐手段之一,官員財(cái)產(chǎn)申報(bào)與公示制度在美國政治由腐到治的過程中發(fā)揮著舉足輕重的作用。本文對美國的財(cái)產(chǎn)申報(bào)制度的歷史沿革、申報(bào)主體、申報(bào)內(nèi)容、受理與審查、公示與處罰等各個(gè)方面進(jìn)行考察和分析�？傮w而言,美國官員財(cái)產(chǎn)申報(bào)與公示制度以預(yù)防腐敗為主,將道德規(guī)范與法律法規(guī)進(jìn)行了有機(jī)結(jié)合,對官員申報(bào)的內(nèi)容和申報(bào)主體的覆蓋范圍比較務(wù)實(shí)而具策略性。此外,在此制度框架下,各個(gè)環(huán)節(jié)相輔相成,實(shí)現(xiàn)了集中監(jiān)管與權(quán)責(zé)下放的結(jié)合。不過,其電子化程度不高而且有的規(guī)定過于繁雜瑣屑,也造成了不必要的成本。
[Abstract]:As one of the most popular anti-corruption measures in the world, the system of declaring and publicizing officials' property plays an important role in the process of American politics from corruption to governance. This paper investigates and analyzes the historical evolution of the property declaration system in the United States, the main body of declaration, the content of declaration, acceptance and examination, publicity and punishment, and so on. In general, American officials' property declaration and publicity system focuses on the prevention of corruption and organically combines moral norms with laws and regulations, which is pragmatic and strategic in terms of the contents of official declaration and the coverage of the subject. In addition, under the framework of this system, each link complements each other and realizes the combination of centralized supervision and decentralization of powers and responsibilities. However, its electronic degree is not high and some regulations are too complicated and trivial, also caused unnecessary cost.
