【摘要】：隨著經(jīng)濟(jì)和社會(huì)的發(fā)展,人口老齡化的問題凸顯。在人權(quán)主義的影響之下,世界各國陸續(xù)對(duì)成年人監(jiān)護(hù)制度進(jìn)行改革。在這一改革大潮中,我國應(yīng)當(dāng)對(duì)成年人監(jiān)護(hù)制度進(jìn)行完善,引進(jìn)最新的法律理念,使得不僅僅是精神病人,而且更多有需要的成年人能夠通過成年人監(jiān)護(hù)制度來保護(hù)自己的利益。本文是通過對(duì)國外幾個(gè)代表性國家的成年人監(jiān)護(hù)制度進(jìn)行解讀和分析,并對(duì)比《民法總則》和《民法通則》來總結(jié)我國目前成年人監(jiān)護(hù)立法狀況和司法實(shí)踐,來構(gòu)建和完善我國成年人監(jiān)護(hù)制度。因此,本文主要通過幾個(gè)部分來研究成年人監(jiān)護(hù)制度,共四個(gè)章節(jié),主要的研究思路如下:第一章是成年人監(jiān)護(hù)制度基本理論,主要論述成年人監(jiān)護(hù)的概念、性質(zhì)、一般理念和與相關(guān)法律制度,進(jìn)而確定成年人監(jiān)護(hù)的概念。第二章是我國成年人監(jiān)護(hù)制度現(xiàn)狀及評(píng)析,將我國現(xiàn)行有關(guān)成年人監(jiān)護(hù)制度的法律法規(guī)進(jìn)行整理歸納,同時(shí)通過案例數(shù)據(jù)分析,從立法現(xiàn)狀和司法實(shí)踐兩個(gè)方面來對(duì)我國成年人監(jiān)護(hù)制度的現(xiàn)狀進(jìn)行評(píng)析。第三章是國外代表性國家成年人監(jiān)護(hù)制度研究與借鑒,本章節(jié)主要有三大部分組成,首先是從幾個(gè)國家成年人監(jiān)護(hù)制度演變開始論述,接著對(duì)幾個(gè)國家的法定監(jiān)護(hù)和意定監(jiān)護(hù)兩種不同制度進(jìn)行對(duì)比分析,從監(jiān)護(hù)事務(wù)、被監(jiān)護(hù)人、監(jiān)督等方面來對(duì)幾個(gè)國家的監(jiān)護(hù)制度進(jìn)行歸納和評(píng)價(jià)。第四章是我國成年人監(jiān)護(hù)制度之構(gòu)建,通過前文的研究,筆者主要是從立法層面上提出幾點(diǎn)建議和措施。建議在未來有條件下制定《成年人監(jiān)護(hù)法》,將法定監(jiān)護(hù)和意定監(jiān)護(hù)的內(nèi)容具體化,特別在監(jiān)護(hù)事務(wù)和監(jiān)督上可以規(guī)定更為詳細(xì)具體。其次,在意定監(jiān)護(hù)制度中創(chuàng)設(shè)兩個(gè)保護(hù)措施,可以將更多特殊成年人納入保護(hù)范圍內(nèi)。同時(shí),要加強(qiáng)司法機(jī)關(guān)和行政機(jī)關(guān)的監(jiān)督職責(zé),建立監(jiān)護(hù)登記制度,最終使得該制度能夠切實(shí)保障被監(jiān)護(hù)人的利益,發(fā)揮其真正的作用。
[Abstract]:With the development of economy and society, the problem of population aging is prominent. Under the influence of human rights doctrine, every country in the world has carried on the reform to the adult guardianship system one after another. China should improve the adult guardianship system, introduce the latest legal concepts, so that it is not only mental patients. Moreover, more and more adults in need can protect their own interests through the adult guardianship system. This article is through the interpretation and analysis of the adult guardianship system of several representative countries abroad. And compare the General principles of Civil Law and the General principles of Civil Law to summarize the current status of adult guardianship legislation and judicial practice in order to build and improve the adult guardianship system in China. This paper mainly through several parts to study the adult guardianship system, there are four chapters, the main research ideas are as follows: the first chapter is the basic theory of adult guardianship system, mainly discusses the concept and nature of adult guardianship. General concept and related legal system, and then determine the concept of adult guardianship. The second chapter is the status quo and evaluation of adult guardianship system in China. The current laws and regulations of adult guardianship system in China are summarized and analyzed through case data. From the legislative situation and judicial practice to analyze the status of adult guardianship system in China. The third chapter is representative of the foreign countries adult guardianship system research and reference, this chapter is composed of three parts. First of all, it begins with the evolution of adult guardianship system in several countries, and then makes a comparative analysis of the two different systems of legal guardianship and determined guardianship in several countries. Supervision and other aspects of several countries to summarize and evaluate the guardianship system. Chapter 4th is the construction of our adult guardianship system, through the previous study. The author mainly puts forward several suggestions and measures from the legislative level. It is suggested that the adult guardianship law should be formulated in the future and the content of statutory guardianship and determined guardianship should be concretized. Especially in guardianship matters and supervision can be more detailed and specific. Secondly, care about the establishment of guardianship system in the creation of two measures of protection, can be more special adults into the scope of protection. At the same time. It is necessary to strengthen the supervisory duties of the judicial and administrative organs and establish a guardianship registration system, so that the system can effectively protect the interests of the ward and play its real role.
