【摘要】： 隨著我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)不斷發(fā)展,壟斷行業(yè)“高福利”問(wèn)題日益凸顯�！案＠�腐敗”更是成為了當(dāng)前社會(huì)的熱點(diǎn)問(wèn)題,引起了社會(huì)公眾強(qiáng)烈的不滿(mǎn)和質(zhì)疑�！案＠�腐敗”是指壟斷性行業(yè)濫用壟斷權(quán)力將其掌握的國(guó)有行業(yè)資源,以福利的名義無(wú)償或廉價(jià)地提供給本行業(yè)的職工,損害國(guó)家和社會(huì)公眾利益的行為�！案＠�腐敗”是經(jīng)濟(jì)轉(zhuǎn)型時(shí)期一顆依附于體制的“毒瘤”,嚴(yán)重侵蝕著體制的肌體,對(duì)政治、經(jīng)濟(jì)、文化和社會(huì)等各個(gè)領(lǐng)域造成了極大危害。 隨著“福利腐敗”的危害日益凸顯,其實(shí)質(zhì)也逐漸暴露出來(lái)�！案＠�腐敗”是壟斷行業(yè)濫用壟斷公權(quán)力,通過(guò)侵吞行業(yè)資源為其員工創(chuàng)造高福利的行為,其實(shí)質(zhì)是一種濫用權(quán)力損害國(guó)家和社會(huì)公眾利益的權(quán)力犯罪。 “福利腐敗”的社會(huì)危害性極大,必須采取有效措施予以遏制。壟斷行業(yè)的高福利得以產(chǎn)生和維持,所憑借的是其所掌握的壟斷公權(quán)力�！案＠�腐敗”這一權(quán)力犯罪得以實(shí)施,其中最核心的因素就是壟斷權(quán)力的濫用。因此,建立科學(xué)完善的權(quán)力制約機(jī)制,有效遏制壟斷行業(yè)公權(quán)力的濫用,乃是治理“福利腐敗”的首要問(wèn)題。
[Abstract]:With the continuous development of the socialist market economy in China, the problem of "high welfare" in monopoly industries is becoming increasingly prominent. "Welfare corruption" has become a hot issue in the current society. "Welfare corruption" refers to the monopoly industry abusing monopoly power to control its state-owned industry resources, in the name of welfare, freely or cheaply provided to the workers in this industry. Welfare corruption is a malignant tumor attached to the system in the period of economic transformation, which seriously erodes the body of the system and causes great harm to the political, economic, cultural and social fields. As the harm of "welfare corruption" becomes more and more prominent, its essence is gradually exposed. "welfare corruption" is the behavior of abusing monopoly public power in monopoly industry and creating high welfare for its employees through embezzlement of industry resources. Its essence is a power crime of abusing power to harm the interests of the state and the public. The social harm of "welfare corruption" is great, we must take effective measures to contain it, and the high welfare of monopoly industry can be produced and maintained, which depends on the monopoly public power and the power crime of "welfare corruption". The most important factor is the abuse of monopoly power. Therefore, to establish a scientific and perfect power restriction mechanism and effectively curb the abuse of public power in monopoly industry is the most important problem in controlling "welfare corruption".
