【摘要】： 作為司法制度的重要組成部分,司法鑒定制度在現(xiàn)代訴訟中發(fā)揮著日益重要的作用。司法鑒定人是司法鑒定工作的具體承擔(dān)者和實(shí)施者,鑒定人資格則被認(rèn)為是鑒定制度中的核心問(wèn)題。 2005年2月全國(guó)人大常委會(huì)審議通過(guò)《關(guān)于司法鑒定管理問(wèn)題的決定》,2005年9月司法部公布《司法鑒定人登記管理辦法》,對(duì)我國(guó)司法鑒定人的資格作了初步規(guī)范,初步確立了司法鑒定人準(zhǔn)入制度的基本框架。但是,這些法律、規(guī)章的規(guī)定過(guò)于原則和籠統(tǒng),沒(méi)有從根本上消除現(xiàn)行司法鑒定人資格制度存在的問(wèn)題。因此,從建立系統(tǒng)、完善的司法鑒定人資格制度的目標(biāo)出發(fā),有必要對(duì)我國(guó)司法鑒定人資格制度的相關(guān)問(wèn)題作進(jìn)一步的研究和探討。 首先以鑒定人的概念為切入點(diǎn),對(duì)鑒定人資格制度的一般理論進(jìn)行了闡述與分析,介紹了鑒定人的概念、以及司法鑒定人資格的傳統(tǒng)構(gòu)成：法律資格、技術(shù)資格和執(zhí)業(yè)資格。在此基礎(chǔ)上,通過(guò)對(duì)司法鑒定人資格域外立法例的比較,進(jìn)而得出一些啟示：鑒定人資格獲取方式上的靈活性以及臨時(shí)授權(quán)資格的出現(xiàn)。經(jīng)過(guò)反思,并且分析我國(guó)鑒定人資格制度的現(xiàn)狀及產(chǎn)生問(wèn)題的原因,發(fā)現(xiàn)我國(guó)司法鑒定人資格制度存在如下問(wèn)題亟需解決：司法鑒定人準(zhǔn)入規(guī)則不健全；司法鑒定人資格禁止性規(guī)定不人性化；偵查機(jī)關(guān)所屬鑒定人的資格特殊化。從我國(guó)的司法鑒定實(shí)踐出發(fā),提出幾點(diǎn)改革路徑：第一,立法系統(tǒng)化、細(xì)致化；第二,司法鑒定人資格的重構(gòu)；第三,偵查機(jī)關(guān)所屬鑒定人的改制；第四,完善司法鑒定人名冊(cè)的模式。通過(guò)以上措施來(lái)具體完善我國(guó)的司法鑒定人資格制度,以改變我國(guó)目前鑒定人資格制度的現(xiàn)狀,建立一個(gè)科學(xué)、公正的鑒定人資格制度。
[Abstract]:As an important part of judicial system, judicial identification system plays an increasingly important role in modern litigation. The qualification of expert is regarded as the core problem in the appraisal system. In February 2005, the standing Committee of the National people's Congress deliberated and adopted the decision on the Administration of Forensic expertise. In September 2005, the Ministry of Justice promulgated the measures for the Administration of Registration of Judicial experts, which made preliminary norms on the qualifications of judicial experts in China. The basic framework of the system of access to judicial experts has been preliminarily established. However, the provisions of these laws and regulations are too principled and general and do not fundamentally eliminate the problems existing in the current system of qualification of judicial experts. It is necessary to make further research and discussion on the related problems of the qualification system of judicial connoisseurs in China, starting from the goal of perfecting the qualification system of judicial connoisseurs. First of all, taking the concept of expert as the breakthrough point, this paper expounds and analyzes the general theory of expert qualification system, introduces the concept of expert, and the traditional constitution of the qualification of judicial expert: legal qualification. On this basis, through the comparison of the overseas legislation of the qualification of judicial experts, the author draws some enlightenment: the flexibility of obtaining the qualification of expert and the appearance of the qualification of temporary authorization. By analyzing the present situation and the causes of the problems in the qualification system of our country, it is found that there are the following problems in the qualification system of judicial appraisers in China: the imperfect rules of access to judicial experts; The prohibition of qualification of judicial experts is not humanized; the qualification of experts belonging to investigative organs is specialized. Based on the practice of judicial identification in our country, several reform paths are put forward: first, systematization of legislation, meticulous; second, Reconstruction of the qualification of judicial experts; third, restructuring of experts belonging to investigative organs; fourth, improvement of the model of the roster of judicial experts. Through the above measures, we can concretely improve the qualification system of judicial experts in our country. In order to change the present situation of the qualification system of experts in our country, a scientific and fair qualification system is established.
