【摘要】：現(xiàn)場(chǎng)勘查一直以來都被認(rèn)為是刑事偵查活動(dòng)中最重要的一個(gè)環(huán)節(jié),是所有刑事偵查工作的開始�，F(xiàn)場(chǎng)勘查的質(zhì)量和效率直接影響案件的偵破和刑事訴訟的順利進(jìn)行。而隨著我國法制化建設(shè)的進(jìn)行,現(xiàn)場(chǎng)勘查制度雖有一定發(fā)展,但是仍然不可避免的出現(xiàn)了一系列的問題。本文首先從確定案件性質(zhì)、指導(dǎo)案件偵破、提供刑事訴訟的證據(jù)等方面論述了現(xiàn)場(chǎng)勘查的價(jià)值。再結(jié)合本人工作實(shí)際,對(duì)現(xiàn)場(chǎng)勘查中軟硬件實(shí)力較差、現(xiàn)場(chǎng)勘查程序不規(guī)范、現(xiàn)場(chǎng)勘查考核不符合實(shí)際等問題進(jìn)行了深入分析。然后從程序正義、刑事訴訟法的目的和任務(wù)、新刑訴法的新要求、司法體制改革的新要求、偵查資源有效利用五個(gè)方面對(duì)完善現(xiàn)場(chǎng)勘查制度的必要性進(jìn)行了充分剖析。最后,具體問題具體分析,提出了提高現(xiàn)場(chǎng)勘查軟硬件實(shí)力、建立嚴(yán)格規(guī)范的現(xiàn)場(chǎng)勘查制度、建立符合現(xiàn)場(chǎng)勘查實(shí)際的考核制度等一系列改善措施。本文試圖通過對(duì)我國現(xiàn)場(chǎng)勘查實(shí)踐中存在的問題及完善途徑的探討,為廣大研究學(xué)者和現(xiàn)場(chǎng)勘查實(shí)踐者提供一個(gè)研究討論的平臺(tái)�，F(xiàn)場(chǎng)勘查的質(zhì)量和效率直接影響偵查的效率和刑事訴訟的成敗。因此,我們必須要完善現(xiàn)場(chǎng)勘查制度,使之符合相關(guān)法律制度的發(fā)展要求,更好的服務(wù)于偵查實(shí)戰(zhàn)和刑事訴訟。
[Abstract]:Scene investigation has always been regarded as the most important link in criminal investigation. It is the beginning of all criminal investigation work. The quality and efficiency of on-site investigation directly affect the detection of cases and the smooth progress of criminal proceedings. However, with the development of our country's legal system, the on-site investigation system has developed to a certain extent. However, there are still a series of unavoidable problems. Firstly, this paper discusses the value of on-site investigation from the aspects of determining the nature of the case, guiding the case detection, providing evidence for criminal proceedings, and then combining with the actual work of my own work. This paper makes a deep analysis of the problems such as the poor strength of software and hardware in the field investigation, the nonstandard procedure of the on-site exploration, the non-conformity of the on-the-spot investigation and examination, and so on. Then, from the aspects of procedural justice, the purpose and task of the criminal procedure law, and the new requirements of the new criminal procedure law, The new requirements of the judicial system reform and the effective utilization of investigation resources are analyzed in five aspects: the necessity of perfecting the on-site investigation system. Finally, the concrete problems are analyzed, and the improvement of the software and hardware strength of the on-site exploration is put forward. A series of improvement measures, such as establishing a strict and standardized on-the-spot exploration system and establishing an examination system in line with the actual on-site exploration, are set up. This paper attempts to discuss the problems existing in the practice of on-site exploration in our country and the ways to improve them. The quality and efficiency of on-site investigation directly affect the efficiency of investigation and the success or failure of criminal proceedings. Therefore, we must improve the system of on-site investigation. To make it in line with the development of the relevant legal system requirements, better service in the investigation of actual combat and criminal proceedings.
