【摘要】： 蘇聯(lián)著名詩(shī)人馬雅可夫斯基曾經(jīng)滿懷深情地說(shuō)過(guò):母親的乳汁哺育了整個(gè)人類。在人們的心目中,女性總是和春天、美麗、賢妻良母等形象聯(lián)系在一起的,她們所表現(xiàn)出來(lái)的溫柔、善良、勤勞、賢惠等優(yōu)秀品質(zhì),常常為人們所稱頌。一般認(rèn)為,女性與犯罪是風(fēng)馬牛不相及的兩個(gè)概念,人們往往把犯罪想象為滿臉橫肉、性情粗暴的男人,而對(duì)女性犯罪則會(huì)感到極大的驚奇和不可思議。 然而,女性犯罪卻是一個(gè)實(shí)際存在的社會(huì)問(wèn)題。在形形色色的犯罪行為中,女性犯罪一般集中在流氓、盜竊、詐騙、殺人、拐賣人口等方面。我國(guó)的女性,隨著社會(huì)生產(chǎn)的發(fā)展,在改革、開(kāi)放的條件下,社會(huì)交往逐漸擴(kuò)大,所接受的信息刺激明顯增多,犯罪數(shù)量也有了較快的上升。 人生伊始,就受到社會(huì)環(huán)境的制約和影響,逐漸形成各種思想觀點(diǎn)和行為習(xí)慣,并從中獲取一定的生活知識(shí)和社會(huì)經(jīng)驗(yàn)。我們的社會(huì)盡管還不完善,但其本身并不產(chǎn)生犯罪。違法犯罪的產(chǎn)生,是由于違法犯罪分子直接接觸社會(huì)環(huán)境中存在的某些不良因素并感染至深的結(jié)果。因此,探討女性的違法犯罪,自然也不能忽視社會(huì)中不良的和有害的因素對(duì)她們的影響。 從目前的情況來(lái)看,女性犯罪同其他犯罪同樣也出現(xiàn)了上升的趨向,而且在有些地區(qū),因受多種因素影響,女性犯罪甚至上升的速度高于其他類型的犯罪。這種情況,不能不引起我們的高度重視,同樣,也不能不作為犯罪學(xué)研究中的一個(gè)重要方面。 本文主要從女性犯罪的各個(gè)方面,來(lái)分析女性犯罪產(chǎn)生的原因,以及分析探討女性犯罪所特有的行為特征和心理特征。從而改善法律對(duì)其規(guī)制的科學(xué)性,達(dá)到預(yù)防女性犯罪的目的。 第一章,女性犯罪的概述。本章從女性犯罪的概念、特征等幾個(gè)方面,概括分析了女性犯罪的狀況,認(rèn)為女性犯罪在我國(guó)目前的犯罪學(xué)領(lǐng)域是一個(gè)不可忽視的重要問(wèn)題。 第二章,女性的生理及心理發(fā)展。本章主要研究女性的生理及心理發(fā)展的基礎(chǔ)、形成個(gè)性特點(diǎn)的社會(huì)因素、當(dāng)前女性的社會(huì)性別角色和地位以及婚姻現(xiàn)象中的女性特點(diǎn),通過(guò)分析說(shuō)明了女性犯罪是有一定規(guī)律的,此領(lǐng)域?qū)ε�性犯罪的研究具有一定的啟示作用�?第三章,女性犯罪的原因。本章主要對(duì)當(dāng)今女性犯罪的原因,尤其是我國(guó)女性犯罪的原因和類型予以研究,認(rèn)為女性犯罪的原因不同于其他犯罪,是具有特色的犯罪形式。 第四章,我國(guó)女性犯罪的法律規(guī)制與預(yù)防。本章從以下三個(gè)方面著手:(1)加強(qiáng)對(duì)女性各方面利益的保護(hù);(2)關(guān)注家庭暴力及相關(guān)立法;(3)社會(huì)全方位的預(yù)防。從理論和實(shí)踐兩個(gè)方面論述了女性犯罪法律規(guī)制與預(yù)防的前景。
[Abstract]:The famous Soviet poet Mayakovsky once said affectionately: mother's milk nurtures the whole human being. In people's minds, women are always associated with the images of spring, beauty, good wife and good mother. It is generally believed that women and crime are two different concepts. People often think of crime as a man with a large face and a rough disposition, but it is a great surprise and incredible to a woman to commit a crime. However, female crime is a real social problem. In all kinds of crimes, female crime is concentrated in hooliganism, theft, fraud, murder, human trafficking and so on. With the development of social production, under the conditions of reform and opening up, the social communication has gradually expanded, the information stimulus received has increased obviously, and the number of crimes has increased rapidly. At the beginning of life, it was restricted and influenced by the social environment, and gradually formed a variety of ideas and behavior habits, and acquired certain life knowledge and social experience. Our society, though imperfect, does not itself produce crime. The emergence of illegal crime is the result of direct contact with some harmful factors in the social environment. Therefore, it is not possible to ignore the influence of harmful and harmful factors on women's crimes. From the current situation, female crime and other crimes have also shown an upward trend, and in some areas, due to a variety of factors, female crime even rose faster than other types of crime. This kind of situation, cannot but cause our high attention, similarly, also cannot be regarded as an important aspect of criminology research. This paper mainly analyzes the causes of female crime from all aspects of female crime, and analyzes and discusses the unique behavioral and psychological characteristics of female crime. In order to improve the scientific nature of the regulation of the law, to achieve the purpose of preventing female crime. The first chapter is an overview of female crime. This chapter analyzes the situation of female crime from several aspects, such as the concept and characteristics of female crime, and thinks that female crime is an important problem in the field of criminology of our country at present. The second chapter, the female physiological and psychological development. This chapter mainly studies the basis of women's physical and psychological development, the social factors that form personality characteristics, the current gender roles and status of women, and the characteristics of women in the phenomenon of marriage. Through the analysis, it shows that female crime has certain regularity, and this field has certain enlightening effect to the research of female crime. The third chapter, the reason of female crime. This chapter mainly studies the reason of female crime, especially the reason and type of female crime in our country, and thinks that the reason of female crime is different from other crimes, and it is a characteristic form of crime. Chapter four, legal regulation and prevention of female crime in China. This chapter starts from the following three aspects: (1) to strengthen the protection of the interests of women; (2) to pay attention to domestic violence and related legislation; (3) to prevent all aspects of society. This paper discusses the prospect of legal regulation and prevention of female crime from two aspects: theory and practice.
