【摘要】：犯罪記錄制度是一項(xiàng)控制犯罪保護(hù)個人合法權(quán)利改善社會治理的一項(xiàng)重要制度,我國的該制度正處于剛剛起步的階段,體系性的規(guī)范性文件只有2012年出臺的《關(guān)于建立犯罪人員犯罪記錄制度的意見》,該意見內(nèi)容多為原則性的條款,缺乏可執(zhí)行性,但我國在行賄犯罪記錄登記與查詢以及未成年犯罪記錄封存方面已經(jīng)擁有相關(guān)的具體制度,我國的犯罪記錄制度正處于一個高速發(fā)展的階段,根據(jù)國外該制度發(fā)展的經(jīng)驗(yàn)來看犯罪記錄制度中犯罪人個人合法權(quán)利的保護(hù)常常處于弱勢的一方,是否能形成社會保護(hù)與個人合法權(quán)利保護(hù)的平衡是犯罪記錄制度能否改善社會治理的關(guān)鍵所在,而我國犯罪記錄制度當(dāng)下的大發(fā)展期正處于互聯(lián)網(wǎng)技術(shù)快速發(fā)展的大數(shù)據(jù)時代,犯罪記錄數(shù)據(jù)庫基本是電子數(shù)據(jù)庫的形式,鑒于電子數(shù)據(jù)的易復(fù)制性、永久儲存性以及易傳播性,我國犯罪記錄制度的對犯罪人個人合法權(quán)益的保護(hù)將面臨更大的挑戰(zhàn),而被遺忘權(quán)是在該背景下保護(hù)公民個人數(shù)據(jù)權(quán)利的一個重要權(quán)利,被遺忘權(quán)同犯罪記錄制度也擁有這同樣的精神,因此本文以采用文獻(xiàn)研究法和比較研究法研究被遺忘權(quán)的發(fā)展引出被遺忘權(quán),論述被遺忘權(quán)同犯罪記錄制度價值的一致性以及被遺忘權(quán)對犯罪記錄制度的意義,再將犯罪記錄制度分成管理與登記制度、通報與查詢制度、封存或者消滅制度這三個部分,從這三個部分分別論述被遺忘權(quán)對犯罪記錄制度的改善。文章首先是犯罪記錄中被遺忘權(quán)的提出,介紹了我國犯罪記錄制度的學(xué)術(shù)研究現(xiàn)狀,目前研究多集中在以保護(hù)犯罪人合法權(quán)利為精神的犯罪記錄封存、查詢板塊,而體系性的研究非常少,這同我國當(dāng)前立法狀況和犯罪記錄制度發(fā)展規(guī)律有關(guān)。然后是介紹了我國犯罪記錄制度存在的問題,即容易忽視犯罪人合法權(quán)利的保護(hù)、大數(shù)據(jù)時代給犯罪人信息權(quán)利帶來的挑戰(zhàn)以及缺乏合適的理論作為指導(dǎo)。接著引出源于保障犯罪人合法權(quán)利興于互聯(lián)網(wǎng)大數(shù)據(jù)時代的被遺忘權(quán);其次為被遺忘權(quán)對犯罪記錄制度的挑戰(zhàn),通過介紹被遺忘權(quán)緣起、所屬領(lǐng)域變化以及對被遺忘權(quán)進(jìn)行權(quán)利性的論證,分析被遺忘權(quán)對犯罪記錄的價值以及其對犯罪記錄制度的意義,來論證被遺忘權(quán)同犯罪記錄制度的精神一致性。最后為被遺忘權(quán)對犯罪記錄制度的完善,通過將犯罪記錄制度分為管理與登記制度、通報與查詢制度、封存或者消滅制度三個小的部分,分別以被遺忘權(quán)為視角分析和論證遺忘權(quán)對犯罪記錄制度的改善,幫助犯罪記錄制更好的實(shí)現(xiàn)保護(hù)社會、保障個人合法權(quán)利和改善社會治理的目的。
[Abstract]:The criminal record system is an important system to control crimes and protect the legal rights of individuals to improve social governance. The system in our country is just in its infancy. Systematic normative documents have only the "opinions on establishing a criminal record system" issued in 2012. Most of the opinions are provisions of principle and lack of enforceability. But our country already has the relevant specific system in the bribery crime record registration and the inquiry as well as the minor crime record seal aspect, our country's criminal record system is in a high speed development stage. According to the experience of the development of this system in foreign countries, the protection of the legal rights of the individual offender in the criminal record system is often in a weak position. Whether the balance between social protection and individual legal rights protection can be formed is the key to improve the social governance of criminal record system, and the great development period of our criminal record system is in the big data era of rapid development of Internet technology. The criminal record database is basically in the form of electronic database. In view of the easy reproduction, permanent storage and easy dissemination of electronic data, the protection of the criminal record system for the legitimate rights and interests of individual offenders will be faced with greater challenges. The right to be forgotten is an important right to protect citizens' personal data rights in this context, and the right to be forgotten shares the same spirit as the criminal record system. Therefore, this paper uses the method of literature research and comparative research to study the development of the right to be forgotten, and discusses the consistency between the right to be forgotten and the value of the criminal record system, and the significance of the right to be forgotten to the system of criminal record. Then the criminal record system is divided into three parts: management and registration system, notification and inquiry system, sealing or eliminating system. From these three parts, the improvement of the right to be forgotten to the criminal record system is discussed respectively. The first part of the article is about the right to be forgotten in the criminal record, and introduces the present situation of the academic research on the criminal record system in our country. At present, most of the research focuses on the sealing and querying of the criminal record in the spirit of protecting the legitimate rights of the offender. But the systematic research is very few, which is related to the current legislative situation and the law of the development of the criminal record system in our country. Then it introduces the problems existing in the criminal record system in our country, that is, it is easy to ignore the protection of the criminal's legal rights, the challenge to the criminal's information rights brought by the big data era and the lack of appropriate theory as the guidance. Then it draws out the right to be forgotten, which originates from the protection of the criminal's legal rights in the big data era of the Internet; secondly, the right to be forgotten challenges the criminal record system, and the origin of the right to be forgotten is introduced. In order to demonstrate the spiritual consistency between the right to be forgotten and the criminal record system, this paper analyzes the value of the right to be forgotten to the criminal record and its significance to the criminal record system. Finally, in order to improve the criminal record system of the right to be forgotten, the criminal record system is divided into three parts: management and registration system, notification and inquiry system, sealing or eliminating system. From the perspective of the right to be forgotten, this paper analyzes and demonstrates the improvement of the criminal record system from the perspective of the right to be forgotten, which helps the criminal record system to better protect the society, protect the legal rights of individuals and improve the social governance.
