【摘要】：正法院審判程序主要包括立案、審理、評(píng)議、制作并發(fā)放裁判文書(shū)等階段,每一個(gè)組成部分工作的細(xì)致和到位以及之間的良好過(guò)渡都是取得高質(zhì)量訴訟結(jié)果所必須。本文聚焦從評(píng)議得出裁判結(jié)果到制作裁判文書(shū)這一環(huán)節(jié),重點(diǎn)考察裁判文書(shū)與評(píng)議結(jié)果之間的關(guān)系,首次提出裁判文書(shū)與評(píng)議筆錄的匹配性這一概念,并從實(shí)踐的角度,探明該領(lǐng)域?qū)嶋H存在的問(wèn)題,對(duì)出現(xiàn)問(wèn)題的原因作出一定的理論探討,并進(jìn)一步提出解決問(wèn)題的辦法。
[Abstract]:The trial procedure of the court mainly includes the stages of filing, hearing, evaluating, making and issuing the judgment documents, and so on. Each part of the work of the meticulous and in place and a good transition between the need to achieve high-quality litigation results. Focusing on the relationship between the judgment document and the outcome of the review, this paper first puts forward the concept of the matching between the judgment document and the review record, and from the perspective of practice, to find out the actual problems in this field. The causes of the problems are discussed in theory, and the solutions to the problems are put forward.
