【摘要】：社區(qū)矯正是在20世紀(jì)70年代興起于歐美國家的一種非監(jiān)禁刑,我國于2003年開始此項工作的試點(diǎn),并取得了一定的成績,但也發(fā)現(xiàn)了一些問題。社區(qū)矯正代表著當(dāng)今行刑制度的發(fā)展趨勢,《刑法》修正案(八)實(shí)行社區(qū)矯正的規(guī)定,為司法行政機(jī)關(guān)開展社區(qū)矯正工作提供了法律依據(jù),為全面確立社區(qū)矯正制度,進(jìn)一步完善刑罰執(zhí)行制度,推進(jìn)刑罰執(zhí)行一體化、專門化奠定了基礎(chǔ)。目前,我國社區(qū)矯正制度還處于初步建立的階段,有許多問題還需要進(jìn)一步細(xì)化和明確。比如,適時制定《社區(qū)矯正法》、明確司法行政部門是我國社區(qū)矯正的執(zhí)行機(jī)構(gòu)、規(guī)定社區(qū)矯正官為我國社區(qū)矯正的執(zhí)法人員等等。因此,我國要建立健全社區(qū)矯正制度,首先要明確此制度的成熟不是一蹴而就的,而是需要一個相對長期的過程,必須在建立相應(yīng)的社區(qū)構(gòu)建與完善矯正戰(zhàn)略的基礎(chǔ)上,因地制宜地建立相應(yīng)的社區(qū)矯正機(jī)制,只有這樣才能保證社區(qū)矯正工作在我國順利開展。
[Abstract]:Community Correction is a kind of non-custodial punishment which rose in Europe and America on 1970s. In 2003, China began to pilot this work and made certain achievements. But also found some problems. Community correction represents the current trend of the execution system, "Criminal Law" Amendment (8) to implement the provisions of community correction. It provides the legal basis for the judicial administration to carry out the work of community correction, for the comprehensive establishment of community correction system, the further improvement of the penalty enforcement system, the promotion of the integration of penalty execution, and the establishment of a foundation for specialization. China's community correction system is still in the initial stage of establishment, there are many problems need to be further refined and clear. For example, the timely formulation of "Community Correction Law". It is clear that the judicial administration department is the executive organ of community correction in our country, and the community correction officer is the law enforcement officer of our country. Therefore, our country should establish and perfect the community correction system. First of all, it should be clear that the maturity of this system is not accomplished overnight, but requires a relatively long-term process, and must be based on the establishment of the corresponding community construction and improvement of the corrective strategy. Only by setting up the corresponding community correction mechanism according to local conditions can we ensure the smooth development of community correction in China.
