【摘要】：當前,網(wǎng)絡(luò)空間面臨的安全形勢不容樂觀,如同實體空間一樣,網(wǎng)絡(luò)空間也可能成為戰(zhàn)爭爆發(fā)的場所與武裝攻擊針對的對象。有鑒于此,網(wǎng)絡(luò)空間的自衛(wèi)權(quán)作為防范網(wǎng)絡(luò)威脅、回應(yīng)網(wǎng)絡(luò)攻擊的一種手段得到了國際社會的廣泛認同與實踐,具有充分的法理依據(jù)。類似于傳統(tǒng)自衛(wèi)權(quán),一方面,網(wǎng)絡(luò)空間自衛(wèi)權(quán)的行使也存在著集體自衛(wèi)、預先自衛(wèi)等情形,為了避免合法的自衛(wèi)權(quán)演變成非法的武裝攻擊,其行使無疑需要受到相關(guān)國際法規(guī)制的約束。另一方面,考慮到網(wǎng)絡(luò)攻擊在類型上的多樣性以及網(wǎng)絡(luò)空間本身的隱蔽性,網(wǎng)絡(luò)自衛(wèi)權(quán)的行使也需要遵循必要性與比例性原則的規(guī)范,需要在區(qū)別個案與可行性的基礎(chǔ)上進行具體裁量,避免出現(xiàn)理論與實踐的脫節(jié)。
[Abstract]:At present, the security situation of cyberspace is not optimistic. Just like physical space, cyberspace may also be the object of war outbreak and armed attack. In view of this, the right of self-defense in cyberspace, as a means of preventing network threats and responding to network attacks, has been widely recognized and practiced by the international community and has sufficient legal basis. Similar to the traditional right of self-defence, on the one hand, in the exercise of the right to self-defence in cyberspace, there are situations such as collective self-defence and preemptive self-defence. In order to prevent the legitimate right of self-defence from turning into an illegal armed attack, There is no doubt that its exercise is bound by the regulation of relevant international law. On the other hand, considering the diversity of the types of network attacks and the concealment of cyberspace itself, the exercise of the right of network self-defence also needs to be governed by the principles of necessity and proportionality, In order to avoid the disconnection between theory and practice, it is necessary to make specific discretion on the basis of distinguishing case from feasibility.
