歐空局的重要法律措施對亞洲空間合作的啟示

【摘要】：歐洲空間局(ESA)保障歐洲空間活動的獨立開展的同時也促進歐洲經(jīng)濟和工業(yè)的發(fā)展。通過對歐空局的背景及合作法律框架的分析,可以發(fā)現(xiàn)保障歐空局建立并成功運作的因素除了歐洲一體化的進程之外還有幾個重要的法律措施,包括:確認(rèn)(專)為和平的目的開展空間合作,賦予空間科學(xué)研究合作重要地位,采納"投資返還"原則,鼓勵空間商業(yè)化與私營化以及賦予成員國合作自由并制定多種與非成員國的合作模式對待對內(nèi)和對外空間合作等。這些成功的經(jīng)驗對其他地區(qū)空間合作活動的開展有重要的啟示意義。亞太空間合作組織(APSCO)的諸多法律措施與歐空局類似,但與歐空局相比,其取得的成就尚有差距。為進一步促進亞洲空間合作的發(fā)展,亞太空間合作組織應(yīng)結(jié)合地區(qū)特殊情形,有效借鑒歐洲經(jīng)驗對相關(guān)的法律措施進行調(diào)整。
[Abstract]:The European Space Agency (ESA) guarantees the independent development of European space activities and also promotes the development of European economy and industry. Through the analysis of the ESA background and the legal framework for cooperation, it can be found that there are several important legal measures that guarantee the establishment and successful functioning of ESA, in addition to the process of European integration, Including: recognizing (specifically) space cooperation for peaceful purposes, giving important status to cooperation in space science and research, and adopting the principle of "return of investment", Encourage space commercialization and privatization, give member States freedom of cooperation and develop a variety of cooperation models with non-member States to deal with internal and external space cooperation, etc. These successful experiences have important implications for the development of space cooperation activities in other regions. Many of the legal measures of APSCO (APSCO) are similar to ESA, but there is still a gap between the achievements of APSCO and ESA. In order to further promote the development of space cooperation in Asia, APSCO should adjust the relevant legal measures in the light of the special situation of the region and the experience of Europe.
