中英合同文本的指示語

指示語被廣泛應用到語言哲學、語用學、語義學和心理語言學領域,目前是語用學研究的一個重要課題。指示是指稱的一種,用來指向與某一特定語境有關(guān)的人、物、時間、地點、過程和社會關(guān)系等。指示語理論常被用來分析文學、影視對白、日常交流等對話類型的話語,但是很少涉及法律等正式文本,幾乎沒有用來分析合同語言。 本文試將指示語理論應用到中英文合同文本當中。根據(jù)指示語的定義、本質(zhì)特征及功能,找出合同文本中的指示詞語。根據(jù)這些詞語是否被作為指示語進行專門研究過,將指示語分為兩大類。一類是沒有或很少被作為指示語進行專門研究過的,主要包括“Part A/甲方”、“Part B/乙方”以及其它類似的稱呼,“hereinafter”和“whereof”等山“here”、“there”和“where”等詞與一個或幾個介詞構(gòu)成的古體詞,以及“thiscontract/本合同”等;第二類為那些在論文、專著或者其他文獻中討論過的指示語,如人稱指示語中的第一人稱和第三人稱指示語,篇章指示語中的“as follows/如下”、“below/下列”、“according to/按照”等。本文著重論證討論第一類指示語:對于第二類指...
