論保險(xiǎn)利益原則

【摘要】：在保險(xiǎn)法的諸多概念中,保險(xiǎn)利益原則是其根本所在,與此同時(shí),很多國(guó)家將其作為保險(xiǎn)法中的根本原則和衡量手段,其具有消除賭博行為、防止道德風(fēng)險(xiǎn)、限制賠償額度等重要功能,對(duì)指導(dǎo)實(shí)踐等方面意義重大。保險(xiǎn)利益原則是訂立保險(xiǎn)合同的前提,也是其存續(xù)下去的基礎(chǔ)。2009年,我國(guó)對(duì)舊《保險(xiǎn)法》進(jìn)行了修改,其中對(duì)保險(xiǎn)利益問題做出了最新的修訂,用來在現(xiàn)實(shí)生活中有效地指導(dǎo)保險(xiǎn)實(shí)踐,并取得了非常顯著的成效,使保險(xiǎn)市場(chǎng)的發(fā)展走上了正確的道路。但是另一方面,我們發(fā)現(xiàn)新《保險(xiǎn)法》中仍然有少數(shù)問題突顯出來。本文指出其中的缺陷及其修改建議,創(chuàng)新性提出了虛擬財(cái)產(chǎn)保險(xiǎn)利益的立法研究。本文分為四個(gè)部分,第一部分對(duì)保險(xiǎn)利益問題和相關(guān)概念做了簡(jiǎn)要的敘述。研究保險(xiǎn)利益的概念,并介紹了保險(xiǎn)利益的歷史演進(jìn),通過比較分析得出應(yīng)更規(guī)范保險(xiǎn)利益的內(nèi)涵及外延。第二部分是針對(duì)于英美法系和大陸法系保險(xiǎn)利益的域外考察。通過對(duì)國(guó)內(nèi)外有關(guān)保險(xiǎn)利益原則問題的立法現(xiàn)狀進(jìn)行系統(tǒng)分析和對(duì)比研究,找出各國(guó)（地區(qū)）在立法實(shí)踐中需要反思的內(nèi)容。第三部分是針對(duì)目前我國(guó)《保險(xiǎn)法》領(lǐng)域內(nèi)關(guān)于保險(xiǎn)利益的完善與不足,以保險(xiǎn)利益的界定、財(cái)產(chǎn)保險(xiǎn)利益與人身保險(xiǎn)利益三個(gè)方面進(jìn)行研究。第四部分是對(duì)我國(guó)保險(xiǎn)利益在適用方面的分析和總結(jié),在立法層面提出保險(xiǎn)利益原則創(chuàng)新性改進(jìn)建議。并提出虛擬財(cái)產(chǎn)等無形財(cái)產(chǎn)的保險(xiǎn)利益理論的創(chuàng)新性應(yīng)用,從而使保險(xiǎn)利益原則更有利于《保險(xiǎn)法》的實(shí)施與完善。
[Abstract]:In many concepts of insurance law, the principle of insurance benefit is the fundamental, at the same time, many countries regard it as the fundamental principle and measure means of insurance law, which has the function of eliminating gambling behavior and preventing moral hazard. Limiting the amount of compensation and other important functions, to guide practice and other aspects of great significance. The principle of insurance interests is the prerequisite for concluding insurance contracts and the basis for their survival. In 2009, China amended the old Insurance Law, in which the issue of insurance interests was updated. It is used to guide the practice of insurance effectively in real life, and has achieved very remarkable results, which makes the development of insurance market go on the right path. But on the other hand, we find that there are still a few problems highlighted in the new Insurance Law. This paper points out the defects and some suggestions, and innovatively puts forward the legislative research on the benefit of fictitious property insurance. This paper is divided into four parts, the first part of the insurance interest issues and related concepts made a brief description. This paper studies the concept of insurance interest, introduces the historical evolution of insurance interest, and draws a conclusion that the connotation and extension of insurance interest should be more standardized through comparative analysis. The second part is aimed at the British-American law system and the civil law system insurance interest outside the investigation. Through the systematic analysis and comparative study on the legislation status quo of the principle of insurance interests at home and abroad, the author finds out the contents that need to be reconsidered in the legislative practice of various countries (regions). The third part focuses on the perfection and deficiency of insurance interests in the field of Insurance Law in China, and studies on the definition of insurance interests, property insurance interests and personal insurance interests. The fourth part is the analysis and summary of the application of insurance interests in our country, and puts forward some innovative suggestions on the principle of insurance interests at the legislative level. It also puts forward the innovative application of the theory of insurance interest of intangible property such as virtual property so that the principle of insurance interests is more favorable to the implementation and perfection of the Insurance Law.
