【摘要】：嫖宿幼女罪在最新刑法修正案九中被廢止,雖然該罪已經(jīng)被廢止,但是理論界和實務(wù)界中對其議論并未停止。本文認為,廢除嫖宿幼女罪被廢除的原因,主要在于其司法實踐中審判效果不佳,而許多學(xué)者認為,其存在導(dǎo)致法律體系混亂,并且不利于對幼女的保護。世界上許多主要國家并沒有專門的嫖宿幼女罪,而是主要單獨對兒童的性侵犯行為進行規(guī)制,對此,我國廢除嫖宿幼女罪符合目前的國際趨勢,有利于我國未來在對兒童的性侵犯和性行為方面建立專門的保護體系。
[Abstract]:The crime of whoring the young woman in the latest criminal law was abolished in the most recent amendment to the criminal law. Although the crime has been abolished, the theoretical and practical circles have not stopped the discussion in the theoretical and practical circles. In this paper, the reasons for the abolition of the crime of the sale of the young women of the clients mainly lie in the poor trial effect in the judicial practice, and many scholars believe that the existence of the legal system is in disorder and is not conducive to the protection of the young women. In many of the world's main countries, there is no special sexual abuse of young women, but the sexual abuse of children is regulated mainly. In this regard, it is in accordance with the current international trend to abolish the crime of the girl and the girl in our country. It is beneficial to the future of our country to set up a special protection system for the sexual assault and sexual behavior of children.
