【摘要】： 我國(guó)已于2001年12月正式加入WTO，這將使我國(guó)技術(shù)型企業(yè)參與國(guó)際競(jìng)爭(zhēng)面臨著許多機(jī)遇；但與此同時(shí)，加入世界貿(mào)易組織，我國(guó)知識(shí)產(chǎn)權(quán)法律制度的保護(hù)水平應(yīng)當(dāng)提高到世貿(mào)組織所要求的程度，同時(shí)入世所引起的環(huán)境方面的巨變，也給我國(guó)技術(shù)型企業(yè)帶來(lái)了極大的挑戰(zhàn)。WTO的加入，外國(guó)著名企業(yè)將長(zhǎng)驅(qū)直入中國(guó)市場(chǎng)，我國(guó)技術(shù)型企業(yè)將在家門口面對(duì)面地同具有技術(shù)優(yōu)勢(shì)的國(guó)外企業(yè)進(jìn)行競(jìng)爭(zhēng)，并遵循著同樣的游戲規(guī)則，承受社會(huì)、文化、倫理等環(huán)境變化而帶來(lái)的壓力，因而在中國(guó)技術(shù)型企業(yè)中納入專利戰(zhàn)略管理已顯得極為必要。 在競(jìng)爭(zhēng)越來(lái)越激烈的今天，專利工作在企業(yè)中的重要性也越來(lái)越強(qiáng)。專利工作的好壞直接決定著企業(yè)能否建立核心競(jìng)爭(zhēng)力，從而在國(guó)際競(jìng)爭(zhēng)和技術(shù)較量中披荊斬棘，縱橫馳騁。而在當(dāng)前，我國(guó)技術(shù)型企業(yè)的專利戰(zhàn)略管理現(xiàn)狀不容樂(lè)觀，絕大多數(shù)企業(yè)專利意識(shí)淡薄，不重視專利申請(qǐng)和專利保護(hù)，更談不上把專利管理提升到戰(zhàn)略的高度，入世之前，中國(guó)技術(shù)型企業(yè)已在專利戰(zhàn)略管理上處于下風(fēng)，入世之后，中國(guó)技術(shù)型企業(yè)如果不迅速采取相應(yīng)的措施，制定適合本企業(yè)的專利戰(zhàn)略，并將陷入嚴(yán)重的專利危機(jī)，并為此付出巨大的代價(jià)，前不久發(fā)生的美國(guó)企業(yè)向中國(guó)DVD生產(chǎn)廠商索要專利許可費(fèi)以及日本對(duì)中國(guó)摩托車企業(yè)的封殺事件，已為廣大的中國(guó)技術(shù)型企業(yè)敲響了一記警鐘。因此，中國(guó)技術(shù)型企業(yè)必須馬上轉(zhuǎn)變觀念，將企業(yè)中的專利工作提上日程，，上升到戰(zhàn)略的高度，探索具有本企業(yè)特色的專利戰(zhàn)略，并予以有效的實(shí)施和嚴(yán)密的控制。 本文系統(tǒng)論述了在加入WTO的背景下，中國(guó)技術(shù)型企業(yè)所面臨的環(huán)境方面的諸多變化；在伴隨入世所帶來(lái)的許多挑戰(zhàn)的同時(shí)，為了建立核心競(jìng)爭(zhēng)力、在激烈的市場(chǎng)競(jìng)爭(zhēng)中獲取競(jìng)爭(zhēng)優(yōu)勢(shì)，中國(guó)技術(shù)型企業(yè)應(yīng)選擇什么樣的專利戰(zhàn) 四川大學(xué)碩士學(xué)位論文 略？如何對(duì)專利戰(zhàn)略進(jìn)行有效管理和運(yùn)營(yíng)？專利戰(zhàn)略如何實(shí)施？實(shí)施過(guò)程中如 何對(duì)專利戰(zhàn)略進(jìn)行有效控制和評(píng)價(jià)？本文作者在這些方面進(jìn)行了仔細(xì)的思考， 在借鑒前人研究結(jié)果和對(duì)若干行業(yè)進(jìn)行調(diào)研的基礎(chǔ)上，提出了作者對(duì)于中國(guó)技 術(shù)型企業(yè)專利戰(zhàn)略管理方面的一些研究成果。希望能通過(guò)這些研究，為中國(guó)技 術(shù)型企業(yè)的專利戰(zhàn)略管理提供有益的參考。
[Abstract]:In December 2001, China formally joined the WTO, which will make our technological enterprises face many opportunities to participate in international competition, but at the same time, China has joined the World Trade Organization. The level of protection of intellectual property legal system in China should be raised to the level required by the WTO. At the same time, the great changes in the environment caused by China's entry into the WTO have also brought great challenges to our technological enterprises. Foreign famous enterprises will drive into the Chinese market for a long time. Our technological enterprises will face to face face to face with foreign enterprises with technological advantages at home, and will abide by the same rules of the game and bear with society and culture. Because of the pressure brought by the change of ethics, it is necessary to incorporate patent strategy management into Chinese technological enterprises. In today's increasingly fierce competition, the importance of patent work in enterprises is becoming stronger and stronger. The quality of patent work directly determines whether enterprises can establish core competitiveness, and thus in the international competition and technology competition. At present, the status quo of patent strategy management in China's technology-based enterprises is not optimistic. Most enterprises have weak patent awareness, do not attach importance to patent applications and patent protection, let alone elevate patent management to a strategic height. Before China's entry into WTO, China's technological enterprises have been in a weak position in patent strategy management. After China's entry into the WTO, if Chinese technological enterprises do not take appropriate measures to formulate patent strategies suitable for their own enterprises, they will fall into a serious patent crisis. And paid a huge price for this. The recent incident in which US enterprises demanded patent licensing fees from Chinese DVD manufacturers and Japan banned Chinese motorcycle enterprises has sounded a wake-up call for the vast number of Chinese technology-based enterprises. Chinese technological enterprises must immediately change their ideas, put the patent work in the enterprises on the agenda, rise to the strategic level, explore the patent strategy with their own characteristics, and effectively implement and strictly control it. This paper systematically discusses many changes in the environment that Chinese technological enterprises are facing under the background of China's entry into WTO, and at the same time, in order to establish the core competitiveness, with many challenges brought about by China's entry into the WTO, In order to gain competitive advantage in the fierce market competition, what kind of patent war should Chinese technological enterprises choose? Master thesis of Sichuan University. Slightly? How to manage and operate patent strategy effectively? How to implement patent strategy? In the process of implementation, such as. How to effectively control and evaluate patent strategy? The author has carefully considered these aspects. Based on the previous research results and the investigation of some industries, the author puts forward the author's opinion on Chinese technology. Some research achievements in patent strategy management of technological enterprises. We hope that through these studies, we can contribute to the development of Chinese technology. The patent strategy management of the technology type enterprise provides the beneficial reference.
