【摘要】： 近幾年來,在園幼兒人身傷害事故發(fā)生率呈逐年上升趨勢,由其所引發(fā)的法律糾紛也越來越多,成為社會各界廣泛關(guān)注的問題。目前,我國有關(guān)幼兒園人身傷害事故的理論還不完善,事故的預(yù)防和處理在理論和實踐上還存在著許多問題。因此加強對在園幼兒人身傷害事故的研究和探討,提出合理有效的事前預(yù)防和事后處理的辦法,具有重要的現(xiàn)實意義。 本研究采用文獻法、案例分析法和訪談法,在已有研究的基礎(chǔ)上,通過對目前我國幼兒園人身傷害事故發(fā)生的原因以及預(yù)防和處理中存在的問題的分析和探討,就構(gòu)建在園幼兒人身傷害事故預(yù)防和處理體系進行了初步的探討,以期有裨于幼兒園人身傷害事故領(lǐng)域理論與實務(wù)的研究。 本研究首先對國內(nèi)外相關(guān)研究及實踐考察進行了綜述;然后收集了大量有關(guān)在園幼兒人身傷害事故的案例進行分析,并選取了呼和浩特市四所幼兒園進行實地調(diào)查,綜合運用案例分析、訪談等方法就當前我國幼兒園人身傷害事故以及預(yù)防和處理中存在的問題進行了探討和研究;最后,為了更好地預(yù)防和處理在園幼兒人身傷害事故,筆者提出了構(gòu)建在園幼兒人身傷害事故預(yù)防和處理體系的四點建議,分別為建立全方位的教育體系、建立立體式的管理體系、建立全面的合作體系以及建立多渠道的賠償救濟體系。
[Abstract]:In recent years, the incidence of personal injury accidents in kindergarten children is increasing year by year, and the legal disputes caused by them are more and more, which has become a widespread concern of all walks of life. At present, the theory of personal injury accident in kindergarten in our country is not perfect, and there are still many problems in theory and practice in the prevention and treatment of the accident. Therefore, it is of great practical significance to strengthen the research and discussion of personal injury accidents of children in kindergarten, and to put forward reasonable and effective methods of prevention and post-treatment. This research adopts the literature method, the case analysis method and the interview method, on the basis of the existing research, through the analysis and the discussion to the present our country kindergarten personal injury accident reason and the prevention and the treatment existing question, This paper makes a preliminary discussion on the system of prevention and treatment of personal injury accidents in kindergarten children in order to study the theory and practice in the field of personal injury accidents in kindergartens. This study first summarizes the relevant research and practical investigation at home and abroad, and then collects a large number of cases of child injury accidents in kindergarten, and selects four kindergartens in Hohhot to carry out field investigation. Comprehensive use of case analysis, interviews and other methods to the current kindergarten personal injury accident and prevention and treatment of the existing problems are discussed and studied; finally, in order to better prevent and deal with the kindergarten child personal injury accident, The author puts forward four suggestions for constructing the prevention and treatment system of personal injury accidents in kindergarten children, respectively, for the purpose of establishing a comprehensive education system and a three-dimensional management system. Establish a comprehensive cooperation system and the establishment of multiple channels of compensation and relief system.
