【摘要】：信息技術的飛速發(fā)展及計算機網絡技術的應用,豐富了我們的生活,也影響了社會的政治、經濟和文化的發(fā)展。伴隨著這些便利,電子證據也越來越多的出現在了當今的訴訟活動中。與傳統(tǒng)證據不同,信息技術與網絡技術的普遍應用,使得電子證據變得隱蔽與智能化,給司法實踐中證據的應用帶來了新問題。在我國,電子證據在法律中的地位尚不明確,鑒于電子證據自身的特點與審查認證的程序異于其他證據,應當明確電子證據在法律上的地位。我國證據法律對于電子證據收集與保全規(guī)定的缺失使得在司法實踐中對電子證據的應用無規(guī)可循。而針對電子證據的收集與保全,傳統(tǒng)的證據收集保全方式又不能恰當適用。本文將結合電子證據的基本理論,采用比較的研究方法對電子證據的收集與保全進行論證,在技術和法律層面,區(qū)分電子證據收集與保全的技術方法和法律模式,積極應對現實的挑戰(zhàn)與困難。 本文分三部分對電子證據的收集與保全進行研究。首先,從電子證據的基礎理論著手,依據電子證據的獨特特點為電子證據的概念做了界定。對于電子證據的法律定位,作者通過對學者們的觀點進行評述與分析,思考了各種定位的優(yōu)劣之后,就其法律定位提出了自己的觀點。其次,在對電子證據的收集與保全上,用了兩部分對收集、保全進行分別闡述。從目前電子證據收集與保全的現狀談起,以基本原則來作為電子證據收集與保全的最高指導,并分析了其收集與保全的專業(yè)技術,對其完善提出了自己的觀點。
[Abstract]:With the rapid development of information technology and computer network technology, enrich our lives, but also influences the social political, economic and cultural development. With the convenience, more and more electronic evidence appear in the current lawsuit. Unlike traditional evidence, the universal application of information technology and network technology the making of electronic evidence becomes subtle and intelligent, brings new problems to the application of the evidence in the judicial practice. In our country, the status of electronic evidence in the law is not clear, in view of the characteristics and examination of electronic evidence of its certification program is different from other evidence, should be clear in the legal status of electronic evidence China's law for lack of evidence. The provisions of electronic evidence collection and preservation of the judicial practice in the application of electronic evidence and irregular. In view of the electronic evidence collection and preservation of evidence, the traditional Collection and preservation mode cannot be directly used. This paper will combine the basic theory of electronic evidence, using comparative research methods collection and preservation of electronic evidence to demonstrate the technical and legal level, electronic evidence collection and preservation technology and law mode, actively respond to the challenges and difficulties of reality.
This paper is divided into three parts: the collection and preservation of electronic evidence research. First of all, starting from the basic theory of electronic evidence, based on the unique characteristics of the electronic evidence concept for the electronic evidence will be defined. For the legal status of electronic evidence, based on the views of scholars to review and analysis, after thinking about various location the advantages and disadvantages, put forward their own views on the legal position. Secondly, in the collection and preservation of electronic evidence, the two part of the collection, preservation were elaborated from the current status of electronic evidence collection and preservation of the talk, in principle as the highest guiding electronic evidence collection and preservation, and analysis of the professional technology of the collection and preservation, the perfect put forward their own views.
