【摘要】： 根據(jù)社科院形勢(shì)分析組和新華社《半月談》等六個(gè)單位進(jìn)行的三次社會(huì)調(diào)查表明，不論是公眾、官員，還是專(zhuān)家學(xué)者，都一致認(rèn)為：腐敗是當(dāng)前中國(guó)頭號(hào)的社會(huì)問(wèn)題。①而作為腐敗現(xiàn)象極端表現(xiàn)的職務(wù)犯罪，，更是為人們深?lèi)和唇^。它不僅越來(lái)越受到黨和政府的高度重視，也越來(lái)越成為學(xué)者們關(guān)注的焦點(diǎn)。本文即是一篇筆者關(guān)于我國(guó)職務(wù)犯罪問(wèn)題研究的拙作。全文共分為四個(gè)部分：第一部分，筆者探討了我國(guó)職務(wù)犯罪的概念和基本特征，并分別從刑法學(xué)和犯罪學(xué)的角度分析了職務(wù)犯罪概念的內(nèi)容，然后根據(jù)該內(nèi)容淺析了職務(wù)犯罪主體特殊性和職務(wù)相關(guān)性的基本特征；第二部分，筆者探討了我國(guó)職務(wù)犯罪的特點(diǎn)和危害，在分析了職務(wù)犯罪大案要案增加幅度大、共同犯罪增多等特點(diǎn)的基礎(chǔ)上，闡釋了職務(wù)犯罪危及政治穩(wěn)定、危害經(jīng)濟(jì)發(fā)展、敗壞社會(huì)風(fēng)氣等危害；第三部分，筆者分別從主、客觀兩大方面探討了我國(guó)職務(wù)犯罪的原因，因?yàn)槁殑?wù)犯罪行為的發(fā)生除了客觀上存在的經(jīng)濟(jì)制度不完善，監(jiān)督機(jī)制、法制不健全等外界誘因外，還有行為人主觀上意志薄弱、心理失衡、罪責(zé)感差、法制觀念淡薄等個(gè)人內(nèi)在因素作用的結(jié)果；第四部分，筆者首先闡述了職務(wù)犯罪預(yù)防的重要性，然后，針對(duì)職務(wù)犯罪的成因提出了職務(wù)犯罪的防治對(duì)策。由于職務(wù)犯罪的形成是多種因素綜合作用的結(jié)果，因此，職務(wù)犯罪的預(yù)防需要政治、法律、道德等多種手段多管齊下，發(fā)揮各自的功能作用，方能有效地治理。
[Abstract]:According to three social surveys conducted by six units, such as the situation Analysis Group of the Academy of Social Sciences and the Xinhua News Agency on the Half-Moon, it is clear that no matter it is the public, officials, or experts and scholars, They all agree that corruption is the number one social problem in China, and as an extreme manifestation of corruption, job-related crimes are abhorrent to people. It is not only paid more and more attention by the Party and government, but also become the focus of scholars. This article is the author of our country on the issue of job-related crimes. The thesis is divided into four parts: the first part, the author discusses the concept and basic characteristics of duty crime in China, and analyzes the content of the concept of duty crime from the angle of criminal law and criminology respectively. Then, according to the content, the author analyzes the characteristics of the subject particularity of duty crime and the correlation of duty. In the second part, the author probes into the characteristics and harm of duty crime in our country, and analyzes the increasing range of major cases of duty crime. On the basis of the characteristics of increasing joint crime, this paper expounds the harm of job-related crime, such as endangering political stability, endangering economic development and damaging social ethos, etc. In the third part, the author discusses the causes of duty crime in China from two aspects: subjective and objective. This is because the occurrence of job-related crimes, in addition to the imperfections of the economic system, the supervision mechanism, the imperfect legal system, and other external causes, the subjective will of the perpetrator is weak, the psychological imbalance, and the sense of guilt are poor. In the fourth part, the author expounds the importance of the prevention of job-related crime, and then puts forward the preventive countermeasures against the causes of the job-related crime. Because the formation of duty crime is the result of the comprehensive action of many factors, the prevention of duty crime needs a variety of means, such as politics, law, morality and so on.
