孟德斯鳩筆下的家庭秩序與政府類型

【摘要】：家庭秩序作為"法的精神"的一部分,在孟德斯鳩的著作中具有獨特的地位,同時也顯現(xiàn)出了很大的張力。他一方面強調(diào)家庭秩序?qū)φ误w的穩(wěn)固起到關(guān)鍵作用,無論專制政府還是共和政府都是如此;但另一方面,他又指出,君主政府之下的家庭秩序,特別是女性地位發(fā)生了很大的變化。他認為,這是與君主政府的原則相契合的,并不會對君主政府造成任何傷害,反而使其受益。從婚姻和家庭價值的變化、女性自由,以及家庭權(quán)威與公民教育的關(guān)系三個層面來看,孟德斯鳩對家庭秩序截然不同的態(tài)度與其政府分類原則之間有著緊密的關(guān)系。
[Abstract]:As a part of the Spirit of Law, family order has a unique position in Montesquieu's works and shows great tension at the same time. On the one hand, he stressed that family order plays a key role in the stability of the political body, both autocratic and Republican governments, but on the other hand, he pointed out that great changes have taken place in the family order under the monarch government, especially in the status of women. In his view, this is in line with the principles of the monarchy and will not cause any harm to the monarchy, but will benefit it. From three aspects: the change of marriage and family value, the freedom of women, and the relationship between family authority and civic education, Montesquieu's attitude towards family order is closely related to the principle of government classification.
