【摘要】：隨著中國大陸地區(qū)與臺灣地區(qū)交流的日益頻繁,兩岸由于歷史原因所造成的刑法理論的差異也在深深的影響著對方刑法學(xué)界理論的研究。以此為典型的是中國臺灣地區(qū)刑法關(guān)于誹謗罪的規(guī)定。兩岸刑法中的誹謗罪在犯罪構(gòu)成特征、免責(zé)事由、法律適用等方面存在較大不同。大陸地區(qū)對誹謗罪的構(gòu)成要件有兩個方面要求:首先要有“捏造事實”的行為,其次要有“情節(jié)嚴(yán)重”的情形。臺灣地區(qū)刑法中對于誹謗罪的構(gòu)成要件方面限制相對較少,體現(xiàn)在并不要求有“捏造事實”的行為和“情節(jié)嚴(yán)重”的情形才構(gòu)成誹謗罪。臺灣地區(qū)多根據(jù)免責(zé)事由的規(guī)定來限制刑法對于誹謗罪的處罰。在法律適用方面,針對歷年來兩岸所發(fā)生的誹謗犯罪,亦有不同的對待與判決理由。本文擬通過對比大陸與臺灣刑法中誹謗罪立法與法律適用方面的不同,從言論自由權(quán)與名譽(yù)權(quán)平衡角度考慮并分析誹謗罪應(yīng)如何在相互借鑒中彼此完善。
[Abstract]:With the increasing exchanges between mainland China and Taiwan, The differences in criminal law theories between the two sides of the Taiwan Strait due to historical reasons are also deeply influencing the study of the other side's criminal law theory. This is typical of the provisions of the criminal law on libel in the Taiwan region of China. The slander in the criminal law of the two sides of the strait is also deeply influenced. Slander is characteristic of crime, There are two requirements for the constitution of libel in mainland China: firstly, there should be "fabricating facts". Secondly, there should be "serious circumstances". In Taiwan's criminal law, there are relatively few restrictions on the elements of libel. This is reflected in the fact that "fabricated facts" and "serious circumstances" are not required to constitute libel. In the Taiwan region, the criminal law restricts the punishment of libel in accordance with the provisions of exemption. In terms of the application of the law, There are also different treatment and judgment reasons for libel crimes on both sides of the Taiwan Strait over the years. This paper intends to compare the legislation and application of libel in the criminal law of mainland China and Taiwan. From the angle of balance between the right of freedom of speech and the right of reputation, this paper analyzes how libel should be perfected in the mutual reference.
