【摘要】： 暴力犯罪以其犯罪行為的突發(fā)性,犯罪手段的殘忍性和犯罪后果的嚴(yán)重傷害性對(duì)社會(huì)秩序和民眾的安全構(gòu)成重大威脅。因此,分析暴力犯罪行為發(fā)生的背景,揭示暴力犯罪行為決策的過程和機(jī)制,為更好地預(yù)防暴力犯罪行為的發(fā)生具有一定的理論意義和實(shí)踐價(jià)值。 本文運(yùn)用訪談法對(duì)哈爾濱市某監(jiān)獄中因暴力犯罪入獄的現(xiàn)服刑人員進(jìn)行了實(shí)證研究。研究顯示,暴力犯罪者的行為大多具有沖動(dòng)、好斗、意氣用事等非理性特征,這與其成長(zhǎng)的家庭環(huán)境和所處的地域亞文化的影響密不可分。進(jìn)一步分析顯示,暴力犯罪者有欠缺的家庭環(huán)境使得其受教育程度普遍偏低下,導(dǎo)致其缺乏發(fā)展?jié)摿�和專業(yè)技能。這意味著其通過合法途徑獲得成功的可能性降低,這也為犯罪行為的發(fā)生提供了潛在的動(dòng)因。調(diào)查顯示,表現(xiàn)在時(shí)間和空間上的情境因素對(duì)犯罪行為的發(fā)生具有催發(fā)作用。在這種情境下,暴力犯罪者對(duì)案發(fā)事件往往進(jìn)行極端化的認(rèn)知,并對(duì)擬采取的暴力行為進(jìn)行合理化的建構(gòu),在對(duì)成本與收益的評(píng)估后進(jìn)行犯罪行為決策。 暴力犯罪者行為決策的發(fā)生過程表明,表面上看似屬于一時(shí)沖動(dòng)的暴力犯罪行為,其發(fā)生與犯罪者成長(zhǎng)的社會(huì)家庭文化背景以及犯罪者對(duì)事件的理解密切相關(guān)。這從另一個(gè)側(cè)面為暴力犯罪的預(yù)防提供了理論依據(jù),通過“親家庭運(yùn)動(dòng)”、重塑社會(huì)亞文化、大力發(fā)展幫扶體系等措施,為青少年的成長(zhǎng)提供良好的發(fā)展環(huán)境,預(yù)防不良習(xí)氣,培養(yǎng)理性精神,從而預(yù)防犯罪行為的發(fā)生。
[Abstract]:Violent crimes pose a major threat to the social order and the safety of the population because of the sudden nature of their criminal acts, the cruelty of the means of committing crimes and the serious harm caused by the consequences of the crime. Therefore, the context in which violent crime occurs is analysed, It is of theoretical significance and practical value to reveal the decision-making process and mechanism of violent criminal behavior in order to better prevent the occurrence of violent criminal behavior. This paper makes an empirical study on the current inmates of a certain prison in Harbin for violent crimes. The research shows that the behavior of violent offenders is mostly irrational, such as impulsiveness, aggression, willpower and so on. This is inextricably linked to the family environment in which they grew up and the impact of their geographical subcultures. Further analysis shows that the lack of a family environment for perpetrators of violence generally leads to a low level of education, This leads to a lack of development potential and professional skills... which means that they are less likely to succeed through legal means, which also provides a potential incentive for the commission of criminal acts. The contextual factors, which are manifested in time and space, have a catalytic effect on the occurrence of criminal behavior. In this situation, the violent offenders tend to carry on the extreme cognition to the crime incident, and carry on the rationalization construction to the violence behavior to be taken. Make criminal decision after evaluating the cost and income. The process of making decisions about the behavior of violent offenders shows that what appears to be an act of violent crime on the face of it is an act of violence on impulse. Its occurrence is closely related to the social and cultural background of the offender's growing up and the offender's understanding of the incident. It provides a theoretical basis for the prevention of violent crime from another aspect, and reinvents the social subculture through the "pro-family movement". To develop the help system and other measures to provide a good development environment for the growth of young people, prevent bad habits, cultivate rational spirit, so as to prevent the occurrence of criminal behavior.
