【摘要】： 中國(guó)正經(jīng)歷著由傳統(tǒng)農(nóng)業(yè)社會(huì)向工商社會(huì)發(fā)展的歷史轉(zhuǎn)型期,農(nóng)村城市化的歷史潮流不可逆轉(zhuǎn),這是市場(chǎng)經(jīng)濟(jì)發(fā)展的必然要求與結(jié)果。經(jīng)濟(jì)的快速發(fā)展、城市化水平的提高,就需要更多的資源,而土地資源因其稀缺性愈顯珍貴,國(guó)家往往采取土地征收的辦法將農(nóng)村集體所有土地轉(zhuǎn)化為國(guó)家所有,同時(shí)將農(nóng)用地轉(zhuǎn)化為建設(shè)用地,以促進(jìn)經(jīng)濟(jì)建設(shè)的高速發(fā)展。然而,我國(guó)的土地征收制度產(chǎn)生于落后的計(jì)劃經(jīng)濟(jì)時(shí)代,根本不能適應(yīng)市場(chǎng)經(jīng)濟(jì)的需要,土地征收中矛盾頗多,而補(bǔ)償問(wèn)題業(yè)已成為矛盾的焦點(diǎn)。正是由于我國(guó)征收補(bǔ)償問(wèn)題立法滯后,補(bǔ)償標(biāo)準(zhǔn)、補(bǔ)償范圍、補(bǔ)償程序等都不夠完善,容易引發(fā)爭(zhēng)議,而解決爭(zhēng)議的行政和司法手段救濟(jì)不力,從而使失地者生活缺少保障,嚴(yán)重影響了農(nóng)村發(fā)展及社會(huì)穩(wěn)定。因此,建立健全我國(guó)的土地征收補(bǔ)償制度是當(dāng)務(wù)之急。本文試圖對(duì)我國(guó)土地征收補(bǔ)償問(wèn)題進(jìn)行系統(tǒng)而深入的研究,找出我國(guó)現(xiàn)存制度中存在的問(wèn)題并分析其原因,提出自己的解決設(shè)想,并希望探索一條具有中國(guó)特色的土地征收補(bǔ)償?shù)臋C(jī)制和辦法,為我國(guó)土地征收補(bǔ)償制度改革提供建議。本文共分四部分:第一部分是土地征收補(bǔ)償制度的起源及理論基礎(chǔ),從歷史的角度和法理的角度來(lái)全面介紹土地征收補(bǔ)償制度,為下文提出問(wèn)題和解決問(wèn)題提供理論依據(jù)。第二部分是我國(guó)土地征收補(bǔ)償制度的變遷、現(xiàn)狀及存在問(wèn)題,通過(guò)歷史與現(xiàn)狀的分析,提煉出我國(guó)現(xiàn)有的土地征收補(bǔ)償制度中存在的主要問(wèn)題。第三部分是我國(guó)土地征收補(bǔ)償制度現(xiàn)存問(wèn)題的成因分析,這一部分主要針對(duì)第二部分提出的問(wèn)題展開(kāi)分析和論證,找出問(wèn)題的
[Abstract]:China is experiencing a historical transition period from traditional agricultural society to industrial and commercial society, and the historical trend of rural urbanization is irreversible, which is the inevitable requirement and result of the development of market economy and the rapid development of economy. With the improvement of urbanization level, more resources are needed, and the more precious the land resources are, the more precious the land resources are, so the country often takes the method of land expropriation to transform the rural collective land into national ownership. At the same time, the agricultural land will be transformed into construction land to promote the rapid development of economic construction. However, the land expropriation system of our country was born in the era of backward planned economy and can not meet the needs of the market economy. There are many contradictions in land expropriation, and compensation has become the focus of contradiction. It is precisely because of the lagging legislation, compensation standard, compensation scope, compensation procedure and so on that the legislation of expropriation and compensation in our country is not perfect enough, and it is easy to cause disputes. However, the administrative and judicial means of resolving the dispute are not effective, which makes the people who have lost land lack the security of life, which seriously affects the rural development and social stability. It is urgent to establish and perfect the land expropriation compensation system in China. This paper attempts to make a systematic and in-depth study of the land expropriation compensation system in China, find out the existing problems and analyze the reasons. The author puts forward his own solution and hopes to explore a mechanism and method of land expropriation and compensation with Chinese characteristics. This paper is divided into four parts: the first part is the origin and theoretical basis of land expropriation compensation system. From the perspective of history and legal theory to introduce the land expropriation compensation system to provide theoretical basis for the following problems and solutions. The second part is the change of land expropriation compensation system in China. Through the analysis of history and current situation, the main problems in the current land expropriation compensation system in China are extracted. The third part is the analysis of the causes of the existing problems in the land expropriation compensation system in China. This part mainly focuses on the analysis and demonstration of the problems raised in the second part, and finds out the
