【摘要】： 土地是民生之本,是社會(huì)經(jīng)濟(jì)發(fā)展的重要基礎(chǔ)。近年來(lái),隨著我國(guó)工業(yè)化、城市化進(jìn)程加快,大量農(nóng)民集體用地經(jīng)由征收轉(zhuǎn)為國(guó)家建設(shè)用地,耕地?cái)?shù)量迅速減少。在全面貫徹落實(shí)科學(xué)發(fā)展觀,日益重視“三農(nóng)”問(wèn)題的今天,在土地征收過(guò)程中,農(nóng)民作為弱勢(shì)群體其利益必須受到保護(hù),政府的土地征收行為必須受到法律的規(guī)制,從而減少土地征收違法行為的發(fā)生,切實(shí)保障農(nóng)民合法權(quán)益。 由于現(xiàn)行的土地征收制度基本形成于計(jì)劃經(jīng)濟(jì)時(shí)代,隨著我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的建立和發(fā)展,其賴(lài)以存在的制度環(huán)境和服務(wù)目標(biāo)已經(jīng)轉(zhuǎn)變,不適應(yīng)性和滯后性日益彰顯,引發(fā)了實(shí)踐中諸多問(wèn)題,因此對(duì)其進(jìn)行改革已迫在眉睫。本文從發(fā)生在S省Z市的違法用地案例和其他相關(guān)案例入手,對(duì)我國(guó)地方政府在土地征收中存在的問(wèn)題進(jìn)行分析,并經(jīng)過(guò)深入分析找出問(wèn)題存在的五個(gè)方面的原因;同時(shí)對(duì)世界主要國(guó)家和地區(qū)先進(jìn)經(jīng)驗(yàn)進(jìn)行了分析和借鑒。在此基礎(chǔ)上,本文以科學(xué)發(fā)展觀作為完善我國(guó)地方政府土地征收行為的指導(dǎo)思想,從改革土地征收的具體制度和完善土地征收的配套措施兩大方面來(lái)提出完善我國(guó)地方政府土地征收行為的具體對(duì)策和建議。 本文的創(chuàng)新之處在于立足時(shí)代發(fā)展的前沿,在科學(xué)發(fā)展觀的指引下,深入考察地方政府在土地征收中存在的問(wèn)題及其原因,通過(guò)借鑒國(guó)外先進(jìn)經(jīng)驗(yàn),提出了符合我國(guó)現(xiàn)實(shí)國(guó)情的詳細(xì)對(duì)策和建議;尤其是突破了單純的法律措施范疇,在配套措施方面提出了行之有效的對(duì)策。不足之處在于由于經(jīng)濟(jì)理論的欠缺,對(duì)采用經(jīng)濟(jì)手段制約地方政府土地征收的對(duì)策研究不夠深入。
[Abstract]:Land is the foundation of people's livelihood and the important foundation of social and economic development. In recent years, with China's industrialization and the acceleration of urbanization, a large number of farmers' collective land has been expropriated and converted into national construction land, and the amount of cultivated land has decreased rapidly. Under the circumstances of carrying out the scientific development view and paying more and more attention to the issue of "agriculture, countryside and farmers", in the process of land expropriation, the interests of farmers, as a vulnerable group, must be protected, and the government's land expropriation behavior must be regulated by law. Thus reduce the occurrence of illegal land expropriation, and effectively protect the legitimate rights and interests of farmers. As the current land expropriation system was basically formed in the planned economy era, with the establishment and development of the socialist market economy in China, the institutional environment and service objectives on which the land expropriation system is based has changed, becoming increasingly inadaptable and lagging. Has caused many questions in practice, therefore carries on the reform to its extremely urgent. From the case of illegal land use in Z city of S province and other relevant cases, this paper analyzes the problems existing in the land expropriation of local government in our country, and finds out the five reasons of the problem after in-depth analysis. At the same time, the advanced experiences of major countries and regions in the world are analyzed and used for reference. On this basis, this paper takes the scientific development view as the guiding ideology to perfect the land expropriation behavior of our local government. From the aspects of reforming the specific system of land expropriation and perfecting the supporting measures of land expropriation, this paper puts forward some concrete countermeasures and suggestions for perfecting the land expropriation behavior of local governments in China. The innovation of this paper is based on the frontier of the development of the times, under the guidance of the scientific development view, the problems existing in the land expropriation of local governments and their causes are thoroughly investigated, and the advanced experience of foreign countries is used for reference. The detailed countermeasures and suggestions in accordance with the actual situation of our country are put forward, especially, the category of pure legal measures is broken through, and the effective countermeasures are put forward in the aspect of supporting measures. Because of the lack of economic theory, the research on the countermeasures of restricting local government land expropriation by economic means is not deep enough.
