【摘要】：研究民辦學校舉辦者的辦學動機,可以找到發(fā)揮其主體性和規(guī)范其行為的路徑,為國家制訂相關政策提供依據(jù)。以人性假設理論為工具,運用質(zhì)化訪談法研究發(fā)現(xiàn),民辦學校舉辦者具有經(jīng)濟人、社會人、自我實現(xiàn)人和復雜人等多種辦學利益訴求。然而,法律賦予舉辦者的財產(chǎn)與非財產(chǎn)類權利與其訴求之間還存在著一定的差距,由此引發(fā)了舉辦者的短期行為和過度控制行為。化解國家需要與舉辦者利益訴求之間的矛盾,應在新《民辦教育促進法》分類管理的框架下,明確舉辦者的權利內(nèi)容,建立權利救濟制度,健全權力監(jiān)督制度,完善義務責任制度,從而實現(xiàn)兩者利益的最優(yōu)化。
[Abstract]:By studying the motivation of the private school organizers, we can find the way to give full play to their subjectivity and standardize their behavior, and provide the basis for the country to formulate relevant policies. Using the theory of human nature hypothesis as a tool, we can find out by using qualitative interview method. The organizers of private schools have a variety of interests, such as economic person, social person, self-actualization person and complex person, etc. However, there is still a certain gap between the property rights and non-property rights conferred by law on the organizers and their demands. This leads to the short-term behavior and excessive control of the organizers. In order to resolve the contradiction between the national needs and the interests of the organizers, it is necessary to clarify the content of the organizers' rights under the framework of the classified management of the new Private Education Promotion Law. Establish the system of right relief, perfect the system of power supervision, perfect the system of obligation and responsibility, and realize the optimization of both interests.
