【摘要】：電力工業(yè)是國(guó)民經(jīng)濟(jì)的第一基礎(chǔ)產(chǎn)業(yè),電力工業(yè)的發(fā)展對(duì)促進(jìn)國(guó)民經(jīng)濟(jì)的發(fā)展和社會(huì)進(jìn)步起到了非常重要的作用。電力工業(yè)的發(fā)展離不開電力建設(shè)項(xiàng)目,但是電力建設(shè)項(xiàng)目因?yàn)槠渫顿Y金額大、項(xiàng)目建設(shè)周期長(zhǎng)、技術(shù)復(fù)雜、建設(shè)和施工制約因素多也歷來被視為風(fēng)險(xiǎn)密集型項(xiàng)目。特別是近十幾年來隨著人們環(huán)保意識(shí)的不斷提高,項(xiàng)目環(huán)保因素也逐漸成為電力項(xiàng)目建設(shè)的一個(gè)日益關(guān)鍵的制約因素,國(guó)內(nèi)國(guó)外有不少電力建設(shè)項(xiàng)目因?yàn)榄h(huán)保因素在建設(shè)過程中被半途終止。由于電站項(xiàng)目投資較大、參與方眾多、合同關(guān)系復(fù)雜,遭遇合同執(zhí)行半途終止時(shí),各參與方如何能夠在有限的時(shí)間內(nèi)形成一個(gè)完整的、合規(guī)的、合理的、具備可操作性的索賠方案,從而有利于多方盡快就索賠方案達(dá)成一致、從而盡可能減少自身利益損失就成了一個(gè)現(xiàn)實(shí)的課題。本文在某一真實(shí)項(xiàng)目的基礎(chǔ)上對(duì)電站項(xiàng)目合同終止索賠方法進(jìn)行了理論結(jié)合實(shí)際的研究,希望能夠找到這一類電站項(xiàng)目合同終止索賠的一般適用的索賠方法,從而能對(duì)日益融入全球化貿(mào)易、走向國(guó)際化道路的中國(guó)企業(yè)在日后需要對(duì)海外工程項(xiàng)目遭遇半途終止進(jìn)行索賠時(shí)能夠稍微有所借鑒和幫助。文章首先介紹論文課題的研究背景和意義、研究?jī)?nèi)容和方法,然后在某一真實(shí)項(xiàng)目信息的基礎(chǔ)上通過系統(tǒng)分析方法對(duì)整個(gè)索賠方案的形成過程做了具體分析和研究:先明確索賠方案的評(píng)價(jià)性指標(biāo)和索賠方案的結(jié)構(gòu),再研究初步索賠方案的形成依據(jù)和形成過程,然后通過對(duì)初步索賠方案的分析得出優(yōu)化的方向和措施,從而形成最終索賠方案。在對(duì)整個(gè)索賠方案的形成過程中,注意在實(shí)際案例的基礎(chǔ)上進(jìn)行理論分析和研究,得出一般適用的索賠方法:索賠首先明確索賠范圍和索賠依據(jù),確定索賠要素;然后按階段、按類別、按性質(zhì)準(zhǔn)備相應(yīng)的索賠方案并自始自終通過索賠方案的時(shí)效性、合理性、合規(guī)性和可操作性四大評(píng)價(jià)指標(biāo)來不斷評(píng)估和完善索賠方案。
[Abstract]:Electric power industry is the first basic industry of national economy. The development of electric power industry plays a very important role in promoting the development of national economy and social progress. The development of electric power industry is inseparable from the electric power construction project, but the electric power construction project is always regarded as a risk intensive project because of its large investment amount, long project construction period, complex technology and many construction and construction constraints. Especially in the past ten years, with the increasing awareness of environmental protection, the environmental protection factor of the project has gradually become an increasingly critical constraint factor in the construction of electric power projects. Many electric power construction projects at home and abroad have been terminated halfway through the construction process due to environmental protection factors. Because of the large investment of the power station project, the large number of participants and the complicated contract relationship, how can each participant form a complete, compliant and reasonable one in a limited time when the contract is terminated halfway through the execution of the contract? It is a practical problem to have an operational claim scheme, which is conducive to reaching an agreement on the claim scheme as soon as possible, thus minimizing the loss of its own interests as much as possible. On the basis of a real project, this paper makes a theoretical and practical study on the method of contract termination of a power station project, hoping to find a general method of claim for termination of contract in this kind of power plant project. Therefore, the Chinese enterprises which are increasingly integrated into the globalization trade and are on the way to internationalization can use for reference and help in the future when they need to end their claims on overseas engineering projects halfway through their journey. First of all, the paper introduces the research background and significance, research content and methods. Then, on the basis of a real project information, the paper makes a concrete analysis and study on the forming process of the whole claim scheme through the method of systematic analysis: firstly, it clarifies the evaluation index of the claim scheme and the structure of the claim scheme. Then it studies the basis and process of the preliminary claim scheme, and then obtains the optimized direction and measures through the analysis of the preliminary claim scheme, and then forms the final claim scheme. In the course of forming the entire claim programme, pay attention to theoretical analysis and study on the basis of actual cases and arrive at a generally applicable claim method: the claim first defines the scope of the claim and the basis of the claim, determines the elements of the claim, and then, by stages, According to category, according to the nature of the corresponding claims, and from beginning to end through the claim scheme effectiveness, rationality, compliance and maneuverability four evaluation indicators to continuously evaluate and improve the claim scheme.
